RESOLUTION NO. 7591
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH OFFERING TO RESCIND THE
AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH
AND THE COUNTY OF ORANGE FOR THE SALE OF
NEWPORT CENTER PROPERTY TO THE COUNTY OF
ORANGE FOR THE LOCATION OF HARBOR JUDICIAL

WHEREAS, on December 23, 1970 the City of Newport
Beach and the County of Orange entered into a contract for
the purchase by the County of a 5.26 acre parcel with an option
to acquire an additional 1.74 acre parcel of land located in
the proposed Newport Beach Civic Center site to be used for
the location of the Harbor Judicial District Court facilities;
and
WHEREAS, pursuant to said land purchase agreement
dated December 23, 1970, the County of Orange paid to the City
of Newport Beach a sum of $439,749; and
WHEREAS, a primary consideration for the sale of the 5.26
acres to the County of Orange was a determination by the Newport
Beach City Council that it would be desirable to have the Court
facility located in Newport Center adjacent to the proposed Civic
Center site; and
WHEREAS, on December 7, 1971 the Board of Supervisors
for the County of Orange voted to consider relocating the Harbor
Judicial District Court facilities to an 8 -acre parcel on the west
side of Jamboree Road just southerly of Campus Drive in Newport
Beach away from the proposed Newport Beach Civic Center site;
and
WHEREAS, the City Council believes that with the re-
location of the Court facilities it would be in the best interest
of the City of Newport Beach and the County of Orange for the

City to reacquire said 5.26 acres, to mutually rescind the
land purchase agreement between the City of Newport Beach
and the County of Orange dated December 23, 1970, and tender
• back to the County of Orange the purchase price of $439,749
plus interest thereon in the amount of $16,500.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the City Council hereby offers
to rescind in total the agreement for the conveyance of real
property dated December 23, 1970 between the City of Newport
Beach and the County of Orange for the sale by the City to the
County of 5.26 acres of land in Newport Center and hereby offers
to tender to the County the full purchase price of $439,749 plus
interest thereon in the amount of $16,500, upon reconveyance of
said property.
BE IT FURTHER RESOLVED that this offer of rescission
is conditioned on the Board of Supervisors for the County of
Orange taking similar action to mutually rescind said agreement.
