A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH ACCEPTING A GRANT
OF EASEMENT FROM THE BALBOA COVES HOME-
OWNERS' ASSOCIATION IN CONNECTION WITH
THE BALBOA COVES ODOR REDUCTION SYSTEM
WHEREAS, the City Council of the City of Newport
Beach has directed the staff to install an odor reduction
system in the Balboa Coves area; and
WHEREAS, part of said odor reduction system will
be installed on private property owned by the Balboa Coves
Homeowners' Association; and
WHEREAS, the Balboa Coves Homeowners' Association
has indicated a willingness to grant the City an easement
over said private property for the purpose of installation
of said odor reduction system; and
WHEREAS, the City Council has determined that it
would be in the best interest of the City to accept the grant
of easement in order to allow the City to proceed with the
installation of said odor reduction system;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said grant of easement is
hereby accepted, and the City Clerk is authorized and directed
to execute and attach thereto a Certificate of Acceptance and
consent to its recording and to cause said document to be
recorded in the Orange County Recorder's office.
