RESOLUTION NO. 8235
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH RECITING THE FACT OF THE GENERAL
MUNICIPAL ELECTION HELD IN SAID CITY ON THE 9TH
DAY OF APRIL, 1974, DECLARING THE RESULT THEREOF
AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW
WHEREAS, a regular general municipal election was held
and conducted in the City of Newport Beach, County of Orange,
State of California, on Tuesday, the 9th day of April, 1974, as
required by law; and
WHEREAS, notice of said election was duly and regularly
given in time, form and manner as provided by law; that voting
precincts were properly established; that election officers were
appointed and that in all respects said election was held and
conducted and the votes cast thereat, received and canvassed and
the returns made and declared in time, form and manner as required
by the provisions of the Elections Code of the State of
California for the holding of elections in cities; and
WHEREAS, pursuant to Resolution No. 8227 adopted the
25th day of March, 1974, the City Clerk canvassed the returns of
said election and has certified the results to this City Council,
said results are received, attached and made a part hereof as
Exhibit "A ";
NOW, THEREFORE, the City Council of the City of Newport
Beach DOES RESOLVE as follows:
SECTION 1. That there were forty -six (46) voting
precincts established for the purpose of holding said election,
consisting of thirty -six (36) consolidations and ten (10) regular
election precincts in the City of Newport Beach as established
for the holding of state and county elections.
SECTION 2. That said regular general municipal electi�
was held for the purpose of electing the following officers of
said City as required by the laws relating to cities in the Stag
of California, to wit;
Four members of the City Council of said City for
the full term of four years.

SECTION 3. That at said regular general municipal
election, the following measures were submitted to the electors
of said City, to wit: Five proposed Charter Amendment measures,
designated as Proposition 1-- Charter Amendment through
Proposition S -- Charter Amendment.
SECTION 5. That the whole number of votes cast in said
City, except absent voter ballots, was 9239 ; that the whole
number of absent voter ballots case in said City was 260 ;
making a total of 9499 votes cast in said City.
SECTION 5. That the names of persons voted for at said
election for Members of the City Council are as follows:
District One:
District Three:
District Four:
District Six:

Peg Forgit
J. Peter Barrett
Ellis R. Glazier
John J. McKerren
Milan M. Dostal
Lyn C. Geronimi
Bill Agee
John Baker
Lucille Kuehn
Joseph C. Stewart
That the measures voted upon at said election are as
follows:
PROPOSITION 1-- CHARTER AMENDMENT: Shall Proposition 1,
which amends, deletes and updates certain sections of the
City Charter to bring it into conformity with existing laws
and to eliminate duplication and conflict, be ratified?
PROPOSITION 2-- CHARTER AMENDMENT: Shall Proposition 2,
which amends certain sections of the City Charter pertaining
to the maximum amounts allowed as reimbursement for expenses
incurred by the Mayor and Councilmen; authorizing the City
Council to fix an amount as reimbursement for expenses for
members of boards and commissions; and delegating authority
to the City Council to adjust said maximum amounts based on
the Consumer Price Index, be ratified?
PROPOSITION 3-- CHARTER AMENDMENT: Shall Proposition 3,
which anends Section 420 of the City Charter to authorize the
City Council to enter into contracts or lease property for a
period of 55 years instead of 25 years, subject to certain
restrictions, be ratified?
PROPOSITION 4-- CHARTER AMENDMENT: Shall Proposition 4,
which amends Section 1110 of the City Charter to increase
from $5,000 to $12,000 the total amount of expenditures on
public works contracts required to be let by the City Council,
to conform with increased construction costs, be ratified?

PROPOSITION S -- CHARTER AMENDMENT: Shall Proposition 5,
which amends Section 1402 of the City Charter to permit the
sale of waterfront property upon prior voter approval, be
ratified?
That the number of votes given at each precinct and
the number of votes given in the City to each of such persons above
• named for the respective offices for which said persons were
candidates and for and against the measures were as listed in
Exhibit "A" attached.

SECTION 6. The City Council DOES DECLARE AND DETERMINE
HOWARD ROGERS was elected as a Member of the City
Council from the First District for the full term of four years.
J. PETER BARRETT was elected as a Member of the City
Council from the Third District for the full term of four years.
MILAN M. DOSTAL was elected as a Member of the City
Council from the Fourth District for the full term of four years.
LUCILLE KUEHN was elected as a Member of the City
Council from the Sixth District for the full term of four years.
That as a result of said election, the vote on the
proposed charter amendment measures above described was as
follows:
A majority of the qualified voters voting on
PROPOSITION 1-- CHARTER AMENDMENT did vote in favor thereof, and
it was adopted.
A majority of the qualified voters voting on
PROPOSITION 2-- CHARTER AMENDMENT did vote in favor thereof, and
it was adopted.
A majority of the qualified voters voting on
PROPOSITION 3-- CHARTER AMENDMENT did not vote in favor thereof,
and it was not adopted.
A majority of the qualified voters voting on
PROPOSITION 4- CHARTER AMENDMENT did vote in favor thereof, and
it was adopted.
A majority of the qualified voters voting on
PROPOSITION 5-- CHARTER AMENDMENT did not vote in favor thereof,

and it was not adopted.
SECTION 7. The City Clerk shall enter on the records
of the City Council a statement of the result of said election
showing:
(1)
The
whole number of votes cast in the city;
(2)
The
names of the persons voted for;
(3)
The
measures voted upon;
(4)
For
what office each person was voted -for;
(5)
The
number of votes given at each precinct to
each person, and for and against each measure;
(6)
The
number of votes given in the city to each
person, and for and against each measure.
SECTION B. The City Clerk shall immediately make and,
upon compliance by the persons elected with the provisions of
Section 11560 and Section 115644 of the Elections Code of the
State of California relating to the filing of campaign-state-
ments, shall deliver to each of such persons so elected a
Certificate of Election signed by her and duly authenticated,
shall administer to each person elected the Oath of Office
prescribed in the State Constitution of the State of California,
and shall have them subscribe thereto and file the same in her
office. WHEREUPON, each and all of said persons so elected
shall be inducted into the respective offices to which they
have been elected.

CITY CLERK'S CERTIFICATE OF CANVASS
I, LAURA LAGIOS, City Clerk of the City of Newport Beach,
• County of Orange, State of California, duly authorized by
Resolution No. 8227 adopted by the City Council of said City on
the 25th day of March, 1974, do hereby certify that I have
canvassed the returns of the regular general municipal election
held in said City on the 9th day of April, 1974, and find that the
number of votes given at each precinct and the number of votes
given in the City to persons voted for, the respective offices for
which said persons were candidates, and the number of votes for
and against the measures were as listed on the attached.
