HomeMy WebLinkAbout8415 - Upper Newport Bay Vehicular & Pedestrian Access Arease • 4 RESOLUTION NO. 8415 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ACCEPTING CERTAIN LANDS AND VEHICULAR AND PEDESTRIAN ACCESS AREAS LOCATED AROUND UPPER NEWPORT BAY FROM THE IRVINE COMPANY WHEREAS, as part of the settlement of certain lawsuits relating to the Upper Newport Bay (Back Bay), The Irvine Company has agreed to dedicate to the public certain lands surrounding Back Bay as well as a number of easements for vehicular and pedestrian access; and WHEREAS, the City Council has reviewed a map depicting these various view areas and access roads and trails and has determined that it would be in the best interest of the City of Newport Beach to accept title to some of these lands and access easements; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach hereby accepts title to the following areas as more accurately shown on a map on file in the office of the City Clerk and made a part herein by this reference and described generally as follows: 1. The pedestrian path to Dover Shores beach off of Polaris Drive; 2. The uplands overlooking and the access road to North Star Beach; 3. The overlook park at the end of Mariners Drive; 4. The area from Constellation to University, including three relocatable vehicular access road easements and the pedestrian trail system in the West Bluff area; 5. The two, ten -foot pedestrian trails following generally the toe of the slope, one on either side of Big Canyon. BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authroized to execute the appropriate documents approved as to form by the City Attorney in order to accomplish -1- the transfer of title to the above - described property interests from The Irvine Company to the City of Newport Beach.
