RESOLUTION NO. 8960
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH SUSPENDING THE
OPERATION OF ALL PARKING METERS LOCATED
IN THE CITY OF NEWPORT BEACH WHILE PROVID-
ING THAT THE CITY MANAGER MAY, IN CERTAIN
SPECIFIED CIRCUMSTANCES, DETERMINE THAT
THE SUSPENSION OF METERS IS NOT APPROPRIATE,
BEGINNING ON THE THIRD MONDAY OF DECEMBER
OF EACH YEAR AND ENDING ON JANUARY 2ND
AND RESCINDING RESOLUTION NO. 8378
WHEREAS, Section 12.44.050 of the Newport Beach
Municipal Code provides that the City Council may determine
by resolution that the operation of some or all parking meters
in the various parking meter zones established within the City
are not necessary for the regulation of traffic and parking
and the City Council may thereafter suspend the operation of
the subject parking meters; and
WHEREAS, certain parking meter zones and parking
meter fees have been established by Ordinance of the City
Council; and
WHEREAS, the City Council of the City of Newport Beach
has provided in the past for the suspension of the operation of
certain meters during the period from the third Monday of
December of each year and ending on January 2nd immediately
thereafter following; and
WHEREAS, in keeping with this tradition and in the
spirit of the Holiday Season, the City Council has determined
that the suspension of the operation of all parking meters in
all parking meter zones within the City is appropriate and that
the use of the parking meters is not necessary for the regula-
tion of traffic and parking except in those certain areas
determined by the City Manager to be necessary and proper for
the proper regulation and control of parking and the flow of
traffic;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that all parking meters located
in all parking meter zones within the City of Newport Beach
are hereby suspended from operation during the period beginning
on the third Monday in December of each year and ending on
January 2nd immediately thereafter following; provided, however,
the City Manager of the City of Newport Beach may determine
that the continued operation of certain parking meters located
within certain parking meter zones is necessary if he determines
that the regulation of traffic and parking require the operation
of said parking meters. In such circumstances, the City
Manager shall refrain from hooding the parking meters and said
meters shall remain in operation during the period of suspension
otherwise provided in this Resolution.
BE IT FURTHER RESOLVED, that Resolution No. 8378 is
hereby rescinded.
