RESOLUTION NO. 8971 <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF NEWPORT BEACH APPROVING A JOINT <br />USE PARKING AGREEMENT FOR THE USE OF <br />• APADANA'S RESTAURANT AT 600D NEWPORT <br />CENTER DRIVE IN CONJUNCTION WITH USE PERMIT <br />NO. 1805 <br />WHEREAS, the Planning Commission of the City of <br />Newport Beach approved Use Permit No. 1805 on November 18, <br />1976, approving Apadana's Restaurant at 600D Newport Center <br />Drive; and <br />WHEREAS, the Planning Commission required parking <br />at the rate of one space for each thirty square foot of public <br />area; and <br />WHEREAS, Section 20.30.035D of the Newport Beach <br />Municipal Code provides that the Planning Commission may <br />recommend and the City Council may approve a waiver of or <br />reduction in off - street parking required when the building site <br />is subject to two or more uses and the maximum parking require- <br />ments for such uses do not occur similtaneously; and <br />WHEREAS, Apadana's Restaurant will be primarily a <br />night time use and the other uses of the parking structure to <br />be used by Apadana's Restaurant will occur during the day time <br />and the overlapping lunch time parking is deemed to be of <br />minimal impact and parking appears to be adequate; and <br />WHEREAS, the Planning Commission has recommended a <br />joint use parking arrangement for the operation of Apadana's <br />Restaurant. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />• the City of Newport Beach that a joint use parking arrangement <br />for Apadana's Restaurant located at 600D Newport Center Drive <br />be approved pursuant to Section 20.30.035D of the Newport Beach <br />
