HomeMy WebLinkAbout8973 - California Coastal Act of 1976RESOLUTION NO. 8973 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH URGING THE CALIFORNIA COASTAL COMMISSION TO DELAY ADOPTION OF THE DRAFT REGULATIONS FOR IMPLEMENTATION OF THE CALIFORNIA COASTAL ACT OF 1976 WHEREAS, the California Legislature approved the California Coastal Act of 1976 which became effective January 1, 1977, hereinafter referred to as "the Act "; and WHEREAS, Section 30620 of the Act provides that the Commission shall adopt interim procedures for the submission, review and appeal of coastal development permit applications and claims of exemption; and WHEREAS, Section 30001.5(e) of the Act encourages state and local initiatives and cooperation in preparing procedures to implement coordinated planning and development for mutually beneficial uses, including educational uses, in the coastal zone; and WHEREAS, in Section 30004 of the Act, the California Legislature found and declared that to achieve maximum responsive- ness to local conditions, accountability and public accessibility, it is necessary to rely heavily on local government and local land use planning procedures and enforcement; and WHEREAS, draft Regulations for Implementation of the Coastal Act of 1976 dated January 3, 1977 were received by the City of Newport Beach on January 7, 1977, which Regulations amended, in a large degree, the draft Regulations distributed by 0 the Commission on December 2, 1976; and WHEREAS, the Commission intends to consider and adopt the draft Regulations at its meeting of January 12, 1977; and is WHEREAS, the City of Newport Beach has not had adequate time to consider, review and comment upon the contents of the Regulations, and in particular, Subchapters 4, 5, 6 and 7 as they relate to local conditions, permits, exclusions and single family residences; and WHEREAS, the City of Newport Beach desires additional time to review, study and make comment on the remaining provisions of the draft Regulations as they relate to local conditions, urban exclusions, categorical exclusions, local issuance of development permits and additions or modifications to existing single family residences. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach as follows: The City urges the Commission to continue consideration and adoption of the proposed Regulations for Subchapters 4, 5, 6 and 7 until January 26, 1977, to allow the City of Newport Beach and all other interested parties adequate time to consider, review and comment upon the contents of said Regulations.
