RESOLUTION NO. 9264
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE CITY ATTORNEY
TO INTERVENE AND REPRESENT THE CITY OF NEWPORT
BEACH IN THE MATTER OF THE STATEMENT OF ISSUES
REGARDING THE APPLICATION OF THE COUNTY OF ORANGE
FOR A VARIANCE FROM THE STATE NOISE STANDARDS
FOR THE REGULATION OF CALIFORNIA AIRPORTS (CASE
NO. L 15743)
WHEREAS, the County of Orange has filed an application
with the State Department of Transportation requesting a
variance from the State Noise Standards for the regulation of
California airports; and
WHEREAS, the Department of Transportation will hold
a public hearing in connection with said variance request; and
WHEREAS, the City of Newport Beach has a vital interest
in said variance proceedings as any decision on the granting
or denying of a variance could have a direct effect on an
increase or modification of use by commercial jet air carriers
operating out of Orange County Airport;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach hereby authorizes the City Attorney
to intervene and become a party on behalf of the City of Newport
Beach in the hearing on the request from the County of Orange
for a Variance from the State Noise Standards for the regulation
of California airports.
BE IT FURTHER RESOLVED that the City Council strongly
opposes any further granting of variances to the County of Orange
and urges the State Department of Transportation to require the
0 Orange County Airport to comply with said Noise Standards immediately.
