RESOLUTION NO. 9634
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH OPPOSING ASSEMBLY BILL 1274
WHEREAS, Assembly Bill 1274 is being considered by
the State Legislature which will enable owners to recover
attorney's fees in all inverse condemnation actions; and
WHEREAS, approval of AB 1274 will impose a significant
cost increase to local government; and
WHEREAS, it is inappropriate at this time for the State
Legislature to impose additional financial burdens on local
government and not to provide for State reimbursement;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach strongly opposes AB 1274 and urges
its defeat.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized to transmit this resolution to the State Senator and
Assemblyman representing the City of Newport Beach.
ADOPTED this 10th day of September , 1979.
