RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH FINDING URGENT NECESSITY FOR
THE PRESERVATION OF PROPERTY, AUTHORIZING THE
STAFF SOLICITATION OF BIDS FOR THE CONSTRUC-
TION OF A STORM DRAIN LINE TO CARRY STORM
WATTER FROM ENSIGN VIEW PARK TO AN EXISTING
CITY - MAINTAINED DRAINAGE PIPE RUNNING BETWEEN
CLIFF DRIVE AND WEST COAST HIGHWAY AND CON-
TAINING A DECLARATION OF FACTS CONSTITUTING
SUCH URGENCY
WHEREAS, in the winter of 1978 -79, storm water
runoff from Ensign View Park caused real and personal property
damage to properties located on West Coast Highway; and
WHEREAS, winter rains in the winter of 1979 -80 may
cause flooding in the same area without the installation of a
needed and necessary storm drain facility; and
WHEREAS, insufficient time presently exists to allow
the formal advertisement of bids for the construction and installa-
tion of storm drain facilities to carry said storm water from
Ensign View Park to an existing drainage pipe running between
Cliff Drive and West Coast Highway prior to the commencement
of the rainy season; and
WHEREAS, a significant probability exists that both
real and personal property damage and personal injury could occur
as a result of uncontrolled flooding without the installation of
said storm drain facility; and
WHEREAS, based on the foregoing, it is the opinion of
the City Council that the urgent necessity for constructing the
storm drain facility to preserve life, health and personal and
real property exists to allow the construction of said facility
without advertising for bids, consistent with Section 1110 of the
Charter of the City of Newport Beach,

NOW, THEREFORE, BE IT RESOLVED that pursuant to
Section 1110 of the Charter of the City of Newport Beach, the
City Public Works Department may, without advertising for bids,
solicit informal bids for the construction of a storm drain line
running from Ensign View Park to an existing storm drain facility,
located easterly of Ensign View Park, running between Cliff Drive
and West Coast Highway, to preserve life, health and public and /or
private property and to prevent flooding of private property
located southerly of Ensign View Park. Further, the construction
of said storm drain facility may proceed through an informal
contract without the necessity of the matter being considered
by the City Council.
