RESOLUTION NO. 9704
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ISSUING A CERTIFICATE OF PUBLIC
CONVENIENCE AND NECESSITY TO OPERATE A TOW TRUCK
SERVICE UPON THE STREETS OF THE CITY OF NEWPORT
BEACH TO COAST TOWING SERVICE, HARBOR TOWING AND
G & W TOWING
WHEREAS, Section 5.13.020 of the Newport Beach
Municipal Code requires that no person shall operate any tow
truck or offer to provide tow truck services upon the streets
of the City of Newport Beach without first having obtained a
certificate of public convenience and necessity therefore; and
WHEREAS, Coast Towing Service, Harbor Towing and
G & W Towing have submitted applications for certificates of
public covenience and necessity to provide tow truck services
upon the streets of the City of Newport Beach; and
WHEREAS, pursuant to Section 5.13.060 of the Newport
Beach Municipal Code the City Council of the City of Newport
Beach has held a public hearing thereon; and
WHEREAS, the City Council of the City of Newport Beach
has considered all evidence which it deems relevant, at said
public hearing, and has determined that each of the three
applicants is qualified to perform the services, has an adequate
number of tow trucks available to provide service within the
City of Newport Beach, would not create an excessive number of
tow truck operations within the City of Newport Beach, each
applicant has adequate facilities, personnel and equipment for
the purposes of the tow truck operations within the City of
Newport Beach; and
WHEREAS, the fees proposed to be charged by said
applicants are fair and just.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach issues a certificate of public
convenience and necessity to Coast Towing Service, Harbor Towing
and G & W Towing to operate tow truck services upon the streets
of the City of Newport Beach.
BE IT FURTHER RESOLVED that the City Council of the
City of Newport Beach, at this time, does not desire to specify
the number of tow trucks that may be operated pursuant to said
certificates, but desires to maintain jurisdiction over said
certificates and, at some future time, may hold further public
hearings on the issue of the number of tow trucks providing
service within the City of Newport Beach.
BE IT FURTHER RESOLVED that the certificate of public
convenience and necessity issued pursuant to Section 5.13.070 of
the Newport Beach Municipal Code shall be valid for an indefinite
period of time until such certificate is suspended or revoked.
