HomeMy WebLinkAbout9706 - General Municipal Election - 4-8-80RESOLUTION NO. 9706 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING CERTAIN OF ITS MEMBERS TO FILE WRITTEN ARGUMENTS FOR CITY MEASURES AND REDESIGNATING PROPOSITION 1, 2 AND 3 AS DESIGNATED BY RESOLUTION NO. 9629 TO MEASURE A, B & C RESPECTIVELY, AND DESIGNATING CERTAIN OF ITS MEMBERS TO FILE WRITTEN ARGUMENTS AGAINST A CERTAIN MEASURE PRESENTLY BEING CIRCULATED AMONG THE REGISTERED ELECTORS OF THE CITY TO CHANGE THE DATE OF THE GENERAL MUNICIPAL ELECTION TO NOVEMBER OF EVEN - NUMBERED YEARS, SHOULD SAID MEASURE QUALIFY FOR THE APRIL 8, 1980 GENERAL MUNICIPAL ELECTION WHEREAS, a general municipal election is to be held in the City of Newport Beach on April 8, 1980, at which time there will be submitted to the qualified electors of said City three City measures, as set forth in Resolution No. 9629, and designated as Proposition 1, Proposition 2 and Proposition 3; and WHEREAS, said City measures, so designated, are generally described as: (1) PROPOSITION ONE: Shall Proposition 1, which amends certain sections of the City Charter, to change the date of election from the second Tuesday in April of even - numbered years to the first Tuesday after the first Monday in November of odd - numbered years be ratified? (2) PROPOSITION TWO: Shall Proposition 2, which amends certain sections of the City Charter pertaining to the maximum amounts allowed as reimbursement for expenses incurred by the Mayor and Councilmen and delegating authority to the City Council to adjust said maximum amounts based on the Consumer Price Index or an annual 5% increase, whichever is lesser, be ratified? -1- (3) PROPOSITION THREE: Shall Proposition 3, which amends Section 401 of the City Charter to change the eligibility to hold office as a member of the City Council, subject to certain restrictions, be ratified? WHEREAS, the Elections Code of the State of California requires City measures to be denominated with letters as opposed to Proposition numbers; and WHEREAS, the City Council desires to change the designa- tion of Proposition 1 as set forth in Resolution No. 9629 to Measure A, and to change the designation of Proposition 2 to Measure B, and to change the designation of Proposition 3 to Measure C; and WHEREAS, the City Council desires to designate certain of its members to file written arguments for City measures; and WHEREAS, a petition is being circulated among the registered electors of the City to change the date of the general municipal election to coincide with the State -wide general election held in November of even - numbered years; and WHEREAS, the City Council desires to designate members of the City Council to submit arguments against said Measure should it qualify to be voted upon at the general municipal election to be held on April 8, 1980; NOW, THEREFORE, the City Council of the City of Newport Beach, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER, as follows: Section 1. The City Council hereby redesignates the City measures as set forth in Resolution No. 9629 as follows: -2- Proposition -1 - Charter Amendment is redesignated Measure A. Proposition 2 Charter Amendment is redesignated Measure B. Proposition 3 - Charter Amendment is redesignated Measure C. Section 2. The City Council hereby designates the following members of the City Council, being Evelyn Hart, Paul Ryckoff and Donald Strauss. to file written arguments for the City measures set forth in the recitals hereof, in accordance with the Elections Code of the State of California, and to change said argument until and including the date fixed by the City Clerk after which no arguments for or against the City measures may be submitted to the City Clerk. Section 3. The City Council hereby authorizes the following members of the City Council, being Evelyn Hart, Paul Ryckoff and Donald Strauss. to file written arguments against the Measure being circulated among the registered electors of the City to change the date of the general municipal election to coincide with the State -wide general election held in November of even - numbered years, should said Measure qualify to be placed on the April 8, 1980 general municipal election.
