A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ORDERING 'THE VACATION AND
ABANDONMENT OF THE RIGHT -OF -WAY PORTION OF
LAKE AVENUE BETWEEN 32ND STREET AND THE MARKET
BASKET PARKING LOT
WHEREAS, the Public Works Director of the City of
Newport Beach has presented to the City Council of the City of
Newport Beach on March 9, 1981, a certain map prepared by the
Public Works Department dated February 9, 1981, and entitled Wa
portion of Lake Avenue to be vacated," Drawing No. R/W- 5436 -L,
which the City is considering vacating; and
WHEREAS, the City Council of the City of Newport Beach
approved and adopted said map on March 9, 1981, and directed the
City Clerk to file same in the proceedings for the abandonment of
said right -of. -way and;
WHEREAS, on April 13, 1981, the City Council held a
public hearing for the purpose of hearing all persons interested
in or objecting to the proposed vacation and abandonment of said
above - described right -of -way; and
WHEREAS, the City Council finds and determines from all
the evidence submitted that the subject right -of -way described
herein and more particularly in Resolution No. 9999 is
unnecessary for present or perspective public use except that an
easement for. watermain facilities shall.be reserved over the
northeasterly 10 ft. of the Lake Avenue right -of -way to be .
vacated,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the right -of -way, more
particularly described as follows, is hereby ordered vacated and
abandoned:
"That portion of Lake Avenue, 40.00 feet
wide, shown as Parcel "G" on a map
recorded in Book 32, Page 41 of Parcel
Maps, in the Office of the County
Recorder, County of Orange, State of
California.
Reserving therefrom an easement, for the
operation and maintenance of waterline
facilities, over the northeasterly 10.00
feet of said Lake Avenue
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to cause a certified copy of such Order
attested by.the Clerk under the Seal of the City of Newport Beach
to be recorded in the office of the County Recorder of the County
of orange.
ADOPTED this 13th day of April, 1981.
