HomeMy WebLinkAbout82-12 - Transient Occupancy Tax Special ElectionWHEREAS, the City Council of the City of Newport Beach desires to submit to the qualified electors of said City, at a special Municipal election, a measure relating to an amendment to the Transient Occupancy Tax (Bed Tax), Section 3.16.030 of the Newport Beach Municipal Code; and WHEREAS, said section presently provides a tax to be paid by each transient, in any hotel, in the amount of six percent (6 %) of the rent charged by the operator; and WHEREAS, the City Council of the City of Newport Beach desires to submit to the qualified electors of said City, in said measure, the question as to whether or not the appropriation limitation imposed by Article XII:I -B of the State Constitution shall be increased in the same amounts and years. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: 1. That, pursuant to the Charter and laws of the State of California, there shall be and there hereby is called and ordered held, in the City of Newport Beach, County of Orange, • State of California, on Tuesday, June 8, 1982, a special Municipal election of the qualified electors of said City, for the purpose of submitting the following question to the voters: RESOLUTION NO. 82 -12 • RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, JUNE 8, 1982, FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY A MEASURE RELATING TO AN INCREASE IN THE TRANSIENT OCCUPANCY TAX (BED TAX) AND TO INCREASE IN LIRE AMOUNT THE APPROPRIATIONS LIMITS WHEREAS, the City Council of the City of Newport Beach desires to submit to the qualified electors of said City, at a special Municipal election, a measure relating to an amendment to the Transient Occupancy Tax (Bed Tax), Section 3.16.030 of the Newport Beach Municipal Code; and WHEREAS, said section presently provides a tax to be paid by each transient, in any hotel, in the amount of six percent (6 %) of the rent charged by the operator; and WHEREAS, the City Council of the City of Newport Beach desires to submit to the qualified electors of said City, in said measure, the question as to whether or not the appropriation limitation imposed by Article XII:I -B of the State Constitution shall be increased in the same amounts and years. That, pursuant to the Charter and laws of the State of California, there shall be and there hereby is called and ordered held, in the City of Newport Beach, County of Orange, • State of California, on Tuesday, June 8, 1982, a special Municipal election of the qualified electors of said City, for the purpose of submitting the following question to the voters: • • SHALL SECTION 3.16.030 OF THE NEWPORT BEACH MUNICIPAL CODE BE AMENDED TO INCREASE THE TRANSIENT OCCUPANCY TAX RATE FROM SIX PERCENT (6%) OF THE RENT CHARGED BY EACH HOTEL OPERATOR TO EIGHT PERCENT (8 %) OF THE RENT CHARGED BY THE OPERATOR TO BE PAID BY THE TRANSIENT' IN ANY HOTEL, EFFECTIVE OCTOBER 1, 1982; AND SHALL THE LIMITATIONS IMPOSED BY ARTICLE XIII -B OF THE STATE CONSTITUTION BE INCREASED IN THE AMOUNT OF REVENUE GENERATED BY THE INCREASE IN SAID TAX RATE AND FOR A PERIOD OF TIME NOT TO EXCEED FOUR YEARS FROM THE DATE OF APPROVAL HEREOF? YES NO 2. That the polls for said election shall be opened and remain open and close to coincide with the polls for the Statewide election to be held on the same day. 3. That an "X" placed in the voting square after the word "Yes ", in the manner hereinbefore provided, shall be counted in favor of the adoption of the proposition; an "X" placed in the voting square after the word "No ", in the manner hereinbefore provided, shall be counted against the adoption of the proposition. 4. That notice of the time and place of holding said election is hereby given, and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in the time, form and manner as is required by law, and that in all particulars not recited in this resolution, said election shall be conducted as provided by law for the holding of Municipal elections in said City. 5. That the City Clerk shall certify to the passage and adoption of this resolution, shall enter the same in the book of original resolutions of said City, and shall make a minute recording of the passage and adoption thereof in the records of the proceedings of the City Council of the City of Newport Beach in the minutes of the meeting at: which the same is passed and adopted. 2 6.
