RESOLUTION NO. 82 -119
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING PARTICIPATION IN
LITIGATION AGAINST THE COUNTY WITH REGARD TO
COUNTY LAND FILL GATE FEES
WHEREAS, the County of Orange has taken action to
impose Land Fill Gate Fees as reflected in the attached
Resolution from the Orange County Division of the League of
California Cities; and
WHEREAS, consideration of litigation is underway to
contest the County's action, the costs of which are to be shared
by participating cities; and
WHEREAS, the City of Newport Beach is concerned over
the substantial impact.of the County fees and the unfair means of
their imposition;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach does hereby endorse proposed litigation
to challenge the County's approval of Gate Fees, and authorizes
the City's participation on a pro -rata basis with other cities.
BE IT FURTHER RESOLVED that additional authorization
will be necessary when specific plans have been determined and a
litigation agreement formalized.
BE IT FURTHER RESOLVED that copies of this Resolution
be forwarded to the County Board of Supervisors and to the Orange
County Division of the League.
ADOPTED this 9th day of August , 1982.
