HomeMy WebLinkAbout83-119 - Supporting Senate Bill 575RESOLUTION NO. 83 -119 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH SUPPORTING SB 575 (FORAM) WHICH BRINGS THE LIABILITY OF A PUBLIC ENTITY FOR NON - ECONOMIC LOSS INTO CONFORMANCE WITH ITS PERCENTAGE OF FAULT. • WHEREAS, the League of California Cities conducted a survey in December, 1982, which disclosed that over $12 million was paid out by 85 cities in settlements and judgments for lawsuits, irrespective of their degree of legal fault; and WHEREAS, due to League of California Cities' lobby efforts, State Senators Foran and Beverly introduced S.B. 575 to limit a city's liability to its degree of legal fault; and WHEREAS, under current law the City of Newport Beach is potentially liable for 100% of a plaintiff's damages even if the City is only 1% legally at fault for a plaintiff's damages; and WHEREAS, unless a city's liability is limited to its degree of legal fault, as proposed by S.B. 575, the City of Newport Beach, other cities and defendants will continue to be subject to liability based upon their ability to pay large awards instead of based upon their respective degrees of legal fault. NOW, THEREFORE, be it resolved, that the City Council of the City of Newport Beach hereby supports Senate Bill 575 as presently worded and any amendments thereto, as well as any additional legislation, that would limit a city's potential liability to its degree of legal fault.
