HomeMy WebLinkAbout98-8 - Record Destruction - City Attorney's OfficeRESOLUTION NO. 98-8 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS OF THE CITY ATTORNEY'S OFFICE AS PROVIDED BY SECTION 34090 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA WHEREAS, the City Attorney's office currently stores approximately one hundred (100) boxes of files and records which are seven (7) to twenty (20) years old. The keeping of numerous records which are seven (7) years old or older, is no longer necessary for the effective and efficient operation of the City Attorney's Office; and WHEREAS, Section 34090 of the Government Code of the State of California provides a procedure whereby any city record that has served its purpose and is no • longer required may be destroyed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport C� Beach as follows: 1. Records, papers and files of the City Attorney's office of the City of Newport Beach which are seven (7) years old or older are hereby authorized to be destroyed as provided for by Section 34090 of the Government Code and in accordance with the provisions of that section, at the discretion of the City Attorney and with his consent, without further action by the City Council of the City of Newport Beach; 2. The provisions of section 1 do not authorize the destruction of (a) records affecting the title to real property or liens thereon; (b) court records; (c) records less than seven (7) years old; (d) official Minutes, Ordinances or Resolutions of the City -1- • • CI Council of the City of Newport Beach or of any City board, committee or commission; unless such records are duplicated records of records maintained in the office of the City Clerk, State Court system or County Recorder's office; 3. The destruction of any record as provided for herein shall be by burning, shredding, recycling or other effective method of destruction authorized by law.
