RESOLUTION NO98 19
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
SUMMARILY VACATING AND ABANDONING PORTIONS OF WATER AND SEWER
EASEMENTS IN LOT 18 OF TRACT NO. 6015 (FASHION ISLAND)
WHEREAS, tho City Council of the City of Newport Beach, pursuant to the
provisions of the Street Vacation Act (Section 8330 et seq. Of the Streets and Highways
• Code) is authorized to summarily vacate and abandon public easements; and
WHEREAS, there are certain portions of water and sewer easements across Lot
18 of Tract No. 6015, recorded February 28, 1977 in Book 12085, Pages 1797 through
1801 inclusive of Official Records in the office of the County Recorder of the County of
Orange, State of California, and which are legally described in Exhibit "A" and depicted
on Exhibit "B" and incorporated herein by this reference as though fully set forth at
length herein; and
WHEREAS, the easements described above have not been used for five
consecutive years by the City of Newport Beach for the purpose for which it was
dedicated or acquired; and
WHEREAS, Southern California Edison has requested that a public utility
easement be reserved over a portion of the easements to be vacated, for Edison
facilities
WHEREAS, the. City Council of the City of Newport Beach reviewed and
considered the various elements of the General Plan of the City of Newport beach prior
to declaring a summary vacation of those certain portions of the easements and has
• determined that the proposed vacation is consistent with the General Plan.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Newport Beach that those certain portions of the water and sewer easements legally
described in Exhibit "A" and shown on Exhibit "B" are hereby vacated and abandoned
reserving therefrom, a public utility easement as legally described and shown on said
Exhibits; and
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have this
Resolution of Vacation, attested by the Clerk, under seal, to be recorded in the Office of
the Recorder of the County of Orange.

EXHIBIT "A"
Those certain easements in the City of Newport Beach, County of Orange, State of
California, described as follows:
A portion of that certain easement, 10.00 feet wide, described in the Grant of Easement
to the City of Newport Beach recorded in Book 12085, Pages 1797 through 1801
inclusive of Official Records in the office of the County Recorder of said County, the
centerline of said portion is described as follows:
Beginning at a point whose coordinates are NORTH 10950.00 and EAST 4747.00 per
map of Tract No. 6015 filed in Book 239, Pages 28 through 41 inclusive of
Miscellaneous Maps in the office of said County Recorder; thence NORTH 140.00 feet;
thence WEST 32.00 feet; thence NORTH 68.00 feet; thence WEST 371.00 feet.
Also a portion of that certain easement, 10.00 feet wide, described as Parcel 6 in said
Grant of Easement to the City of Newport Beach, the centerline of said portion is
described as follows:
Beginning at a point whose coordinates are NORTH 10979.00 and EAST 4730.00 per
map of said Tract No. 6015; thence NORTH 163.00 feet; thence North 69 218'47" West
• 73.60 feet; thence WEST 318.15 feet.
Also Parcel 2 and Parcel 7 as described in said Grant of Easement to the City of
Newport Beach
RESERVING therefrom, a public utility easement, 10.00 feet wide, the centerline being
described as follows:
Commencing at a point whose coordinates are NORTH 10950.00 and EAST 4747.00
per map of Tract No. 6015 filed in Book 239, Pages 28 through 41 inclusive of
Miscellaneous Maps in the office of said County Recorder; thence NORTH 140.00 feet;
thence WEST 32.00 feet; thence NORTH 68.00 feet; thence WEST 151.00 feet to the
True Point of Beginning; thence WEST 220.00 feet.
ALSO RESERVING therefrom, a public utility easement, 10.00 feet wide, the centerline
being described as follows:
Commencing at a point whose coordinates are NORTH 10979.00 and EAST 4730.00
per map of said Tract No. 6015; thence NORTH 163.00 feet; thence North 69 218'47"
West 73.60 feet; thence WEST 98.15 feet to the True Point of Beginning; thence
WEST 220.00 feet.
