HomeMy WebLinkAbout98-54 - LCP 48RESOLUTION NO. 98 -54 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING AN AMENDMENT TO THE LOCAL COASTAL PROGRAM LAND USE PLAN AND SUBMISSION TO THE CALIFORNIA COASTAL COMMISSION [LCP NO. 481 WHEREAS, an application has been filed proposing the redesignation of the property located at 3312 to 3336 Via Lido from Retail and Service Commercial to Multi - Family Residential; and WHEREAS, on February 5, 1998, Planning Commission of the City of Newport Beach held a public hearing regarding Local Coastal Program Amendment 48; and WHEREAS, on March 9, 1998 and April 13, 1998, the City Council of the City of Newport Beach held public hearings regarding Local Coastal Program Amendment 48; and WHEREAS, the public was duly noticed of the public hearings; and • WHEREAS, pursuant to the California Environmental Quality Act, it has been determined that the proposed amendment is categorically exempt under Class 5, minor alterations in land use limitations; and WHEREAS the City Council of the City of Newport Beach Commission finds that the project is consistent with the with the Local Coastal Program Land Use Plan and the California Coastal Act as described below. Coastal Access The proposed project will not interfere with the public's right of access. Adequate vertical and lateral access is provided on the commercial properties immediately north and south of the subject properties and additional access is not necessary. • Land Use • The subject properties are not suitable for recreation and visitor - serving facilities. The subject properties have been developed with residential land uses since 1954. The waterfront of the subject properties provides not beach or shoreline suitable for water - oriented recreational activities. In addition, the lots do not provide sufficient depth to provide adequate off - street parking for commercial development. Commercial Fishing and Recreational Boating The proposed project will not interfere with the development and use of recreational boating or the preservation of boating facilities. The commercial marinas with docking facilities abutting the project site in the West Lido Channel will not be directly impacted by the proposed project. THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY RESOLVE AS FOLLOWS: • SECTION 1: The Local Coastal Program Land Use Plan shall be amended to designate the subject property to Multi - Family Residential. SECTION 2: The Local Coastal Land Use Plan shall be amended to read as provided in Exhibit "A" SECTION 3: the Local Coastal Plan Land Use Plan amendment shall be implemented in a manner fully in conformity with the Coastal Act. SECTION 4: The Planning Director is hereby directed to submit Local Coastal Program Amendment 48 to the California Coastal Commission for review and approval.
