• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
ND
THE 2 AMENDMENT TO THE SAN DIEGO CREEKIUPPER NEWPORT BAY
WATERSHED COOPERATIVE AGREEMENT
AND THE NEWPORT BAY /SAN DIEGO CREEK WATERSHED
SEDIMENT CONTROL MONITORING AND IN- CHANNEL MAINTENANCE PROGRAM
COOPERATIVE AGREEMENT
WHEREAS, the City of Newport Beach is a participant in two cooperative
agreements (a "Section 208 Agreement" and a "Monitoring and Maintenance
Agreement") with various entities that have an interest in preserving and protecting the
Upper Newport Bay; and
WHEREAS, the Executive Committee which oversees the implementation of the
agreements has determined that it is in the Bay's best interest to amend the existing
Section 208 Agreement and to develop a new Monitoring and Maintenance Agreement
to reflect additional responsibility for and interest in protecting the Bay; and
WHEREAS, the proposed changes to the agreements would add additional
participants as signatories to the agreements and change the funding allocation for Bay
monitoring and maintenance expenses;
• NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Newport Beach that the City hereby approves the 2nd Amendment to the San Diego
Creek/Upper Newport Bay Watershed Cooperative Agreement and approves the new
Newport Bay /San Diego Creek Watershed Sediment Control Monitoring and In- Channel
Maintenance Program Cooperative Agreement. The Mayor and City Clerk are hereby
authorized and directed to execute these agreements by and on behalf of the City of
Newport Beach.
ADOPTED this 9th Day of November, 1998.
