RESOLUTION NO. 2005- 25 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT <br />BEACH APPROVING THE ANNUAL ACTION PLAN WHICH IS PART OF <br />THE CONSOLIDATED PLAN, AND THE PROJECTED USE OF <br />COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FOR FY 2005 -2006, <br />AND SUPERCEDING ALL PREVIOUS RESOLUTIONS WHICH ARE <br />INCONSISTENT THEREWITH. <br />WHEREAS, the City of Newport Beach participates in the Department of Housing and <br />Urban Development's Community Development Block Grant (CDBG); and <br />WHEREAS, the City of Newport Beach anticipates receiving $412,233 in CDBG funds <br />for fiscal year 2005 -2006. The City also had Unprogrammed Funds remaining in the CDBG <br />account totaling $80,254; and <br />WHEREAS, the Department of Housing and Urban Development (HUD) requires the <br />City to prepare a 5 -year "Consolidated Plan" document for the CDBG program and which a new <br />Consolidated Plan will be adopted by the City in 2005; and <br />WHEREAS, the Annual Plan is an integral part of the Consolidated Plan; and <br />WHEREAS, on November 3, 2004, the City of Newport Beach's Planning Department <br />conducted a Community Meeting with Newport Beach residents and community based <br />organizations to evaluate the current level of services offered and to identify any new community <br />needs; and <br />WHEREAS; on December 19, 2004, the City published a Notice of Funding Availability <br />(NOFA) in the Daily Pilot newspaper to announce the availability of CDBG funds and solicit <br />proposals for tax - exempt nonprofit organizations that provide eligible CDBG services or projects <br />that benefit Newport Beach; and <br />WHEREAS, on March 14, 2005, the City published a public notice in the Daily Pilot <br />newspaper indicating that the draft Action Plan would be available to the public for review and <br />comment from April 1, 2005, and May 5, 2005; and <br />WHEREAS, on May 10, 2005, the City Council reviewed the draft Action Plan and <br />approved the budget. The City will amend the Action Plan to include any comments and <br />response to the comments that are accepted at the hearing; and <br />WHEREAS, the City Council has considered the community needs, priorities, and <br />strategies set forth in the Consolidated Plan and the Housing Element of the General Plan and <br />concludes the proposed allocation of $412,233 in fiscal year 2005 -2006 CDBG funds plus <br />$80,254 of unprogrammed CDBG Funds is consistent with the Consolidated Plan and Housing <br />Element; and <br />WHEREAS, pursuant to Section 15378 of the State Environmental Guidelines, the <br />proposed project is exempt from the requirements of CEQA. <br />
