RESOLUTION NO. 2005 -51 <br />A RESOLUTION OF THE CITY COUNCIL <br />OF THE CITY OF NEWPORT BEACH <br />ESTABLISHING THE CITY COUNCIL AD HOC <br />SANTA ANA HEIGHTS COMMUNITY CENTER COMMITTEE <br />WHEREAS, the City and the Orange County Development Agency ( "OCDA ") have <br />entered into an agreement whereby the City will coordinate the development and <br />operation of a regional recreational facility or community center ( "Center ") in Santa Ana <br />Heights; and <br />WHEREAS, the City and the Santa Ana Heights community have identified the land <br />and facility at the YMCA of Central Orange County (YMCA) located at 2300 University <br />Drive as the site for the proposed Center; and <br />WHEREAS, the City and the YMCA intend to enter into one or more agreements, <br />including, but not limited to, an Operating Agreement and a Purchase and Sale <br />Agreement to formalize the two entities' relationship regarding the Center; and <br />WHEREAS, the parties intend to establish negotiating teams to develop these <br />agreements and to bring them back to the YMCA Board of Directors and to the City <br />Council for consideration and approval; <br />NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves <br />as follows: <br />SECTION 1: ESTABLISHMENT <br />The City Council Ad Hoc Santa Ana Heights Community Center Committee <br />(Committee) shall be established as of the date this Resolution is approved by four <br />members of the City Council voting at a duly noticed meeting of the City Council. <br />SECTION 2: DUTIES <br />The Committee shall have the following duties: <br />1. In conjunction with City staff, to negotiate with the YMCA of Orange County <br />and /or the County of Orange and its Orange County Development Agency <br />regarding all matters associated with the design, construction, and management <br />of the proposed Community Center; and <br />2. In conjunction with City staff, to review and offer advice regarding any <br />construction or management issues that may arise as the Community Center is <br />under construction and in the Center's initial months of operation. <br />
