RESOLUTION NO. 2005- 17 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />NEWPORT BEACH INITIATING AMENDMENTS TO TITLE 20 <br />OF THE NEWPORT BEACH MUNICPAL CODE RELATED TO <br />THE INCORPORATION OF AN AFFORDABLE HOUSING <br />CHAPTER ESTABLISHING PROVISIONS FOR THE <br />IMPLEMENTATION OF THE CITY'S HOUSING PROGRAMS. <br />(PA 2005 -062) <br />WHEREAS, Housing Program 2.2.1 of the City's Housing Element is a statement <br />of the City's inclusionary housing policy and requires the construction of affordable <br />housing units (or the payment of an in -lieu fee) when the construction of new units is <br />proposed; and <br />WHEREAS, the City is in the process of updating and developing an equitable in- <br />lieu fee option; and <br />WHEREAS, the City must adopt an inclusionary zoning ordinance to provide a <br />legal basis for the application of an in -lieu fee and for the implementation of Housing <br />Program 2.2.1; and <br />WHEREAS, an amendment to Title 20 of the Municipal Code should be <br />considered for the incorporation of regulations related to housing element implementation. <br />A new chapter entitled "20.68 Affordable Housing Regulations ", should be considered to <br />establish provisions for the implementation of the City's housing programs; and <br />WHEREAS, the inclusionary zoning ordinance should be incorporated into the <br />new Chapter 20.68; and <br />WHEREAS, Chapter 20.86 of the Municipal Code currently implements Housing <br />Program 2.2.3 and the provisions of the State Government Code Section 65590 related to <br />the demolition, conversion and construction of low- and moderate - income dwelling units <br />within the Coastal Zone; and <br />WHEREAS, Chapter 20.86 should be relocated and incorporated into the new <br />Affordable Housing Regulations chapter for efficient administration; and <br />WHEREAS, Title 20 requires that any proposed amendment to the zoning <br />regulations be initiated by the adoption of a resolution of intention by the Planning <br />Commission or City Council. <br />
