HomeMy WebLinkAbout86-31 - Vacate Northerly Side of Birch StreetRESOLUTION NO. 86 -31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING CITY'S INTENTION TO VACATE THE NORTHERLY SIDE OF BIRCH STREET BETWEEN MAC ARTHUR BOULEVARD AND VON KARMAN AVENUE, ADJACENT TO THE MAC ARTHUR COURT DEVELOPMENT AND SETTING A DATE FOR PUBLIC HEARING WHEREAS, the City Council of the City of Newport Beach intends to vacate the northerly side of Birch Street between Mac Arthur Boulevard and Von Karman Avenue, adjacent to the MacArthur Court Development; and WHEREAS, the City Council of the City of Newport Beach has considered the various elements of the General Plan of the City of Newport Beach prior to declaring its intent to vacate the street; and WHEREAS, it is the intent of the City Council to reserve, and accept from the vacation, the public service easement over, on and under the street; and WHEREAS, the proposed vacation is conducted pursuant to the provisions of the Public Streets, Highways, and Service Easements Vacation Law (Sections 8300, et seq. of the Streets & Highways Code of the State of California). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the time and place for hearing all persons interested in, or objecting to, the proposed vacation of the street described as Parcel 4 as shown on a Map Filed in Book 196, Pages 40, 41, 42 and 43 of Parcel Maps, in the Office of the County Recorder shall be 7 :30 P.M., or as soon thereafter as the matter may be heard, May 27, 1986, in the Chambers of the City -1- Council of the City of Newport Beach located at 3300 Newport Boulevard, Newport Beach, California. • BE IT FURTHER RESOLVED that this Resolution of Intention shall be published for at least two (2) successive weeks prior to the hearing in the official newspaper of the City of Newport Beach. BE IT FURTHER RESOLVED that Notices, stating the day, hour and place of the hearing, the adoption of the Resolution of Intention, and a description of the easement proposed to be vacated shall be posted not more than three hundred (300) feet apart and at least three (3) notices shall be posted along the street.
