A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH VACATING AND ABANDONING A
PORTION OF A SERVICE EASIM17NT IN BLOCK 95 AND
96 OF IRVINE SUBDIVISION, SOUTHERLY OF TRACT
• 6425 AND NORTHERLY OF POPPY AVENUE
WHEREAS, on May 27, 1986, the City Council of the City
of Newport Beach, adopted Resolution No. 86 -39 declaring its
intention to vacate and abandon a portion of a service easement
(an easement for water transmission lines) in Block 95 and 96 of
Irvine Subdivision, southerly of Tract 6425 and northerly of
Poppy Avenue and setting June 23, 1986 for the date of the public
hearing on the proposed vacation; and
WHEREAS, notice of the proposed vacation has been given
by the City as provided in Sections 8322 and 8323 of the Streets
and Highways Code; and
WHEREAS, on June 23, 1986, the City Council conducted a
public hearing and received evidence offered by all persons
interested in the proposed vacation; and
WHEREAS, the City Council of the City of Newport Beach
has considered the various elements of the General Plan of the
City of Newport Beach and its decision to vacate the water
easement; and
WHEREAS, the City Council finds, from all evidence
submitted, that the water easement described in the Resolution of
Intention and the drawing attached to this Resolution as Exhibit
"A," is unnecessary for present or prospective public use.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that:

1. The water easement described in Resolution Number
• 86 -39 and depicted on Exhibit "A," is hereby vacated and
abandoned pursuant to the provisions of the Public Streets,
Highways and Service Easements Vacation Law (Section 8300, et
seq. of the Streets and Highways Code of the State of
California).
2. That the City Clerk shall cause a certified copy of
this Resolution of Vacation, attested by the Clerk, under seal,
to be recorded without acknowledgement, certificate of
acknowledgement or further proof in the Office of the Recorder of
Orange County.
