A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH ESTABLISHING A FEE
FOR PROCESSING LIVE- ABOARD PERMITS.
WHEREAS, on February 27, 1989 the City Council adopted
Ordinance 89 -7 adding Chapter 17.23 of the Newport Beach
• Municipal Code regulating persons living aboard vessels assigned
offshore mooring (the Live - aboard Ordinance); and
WHEREAS, the Live - aboard Ordinance requires that permits be
accompanied by a fee to be established by Resolution of the City
Council; and
WHEREAS, the Live - aboard Ordinance specifically provides that
the fee not exceed the cost to the City of administering the
ordinance; and
WHEREAS, the Marine Director has conducted a thorough
evaluation of the time necessary to process Live - aboard Permits
and otherwise enforce the Ordinance, and has determined that the
average cost to the City will equal or exceed one hundred and
twenty dollars ($120.00) per year for each permit; and
WHEREAS, the Live - aboard Ordinance limits the number of
permits, establishes a waiting list for those interested in
obtaining permits, and requires the application for placement on
the waiting list to be accompanied by a fee established by
resolution of the City Council; and
WHEREAS, the Marine Director has conducted a thorough and
comprehensive evaluation of the time and effort necessary to
process "waiting list" applications and has determined that a fee
of fifty dollars ($50.00) will equal or exceed the cost incurred
by the City in administering the waiting list provisions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Newport Beach as follows:
That the fee for applying for a Live - aboard Permit pursuant to
• Chapter 17.23 of the Newport Beach Municipal Code shall be one
hundred and twenty dollars ($120.00) for the application for
original permit and the application for renewal of permit; and

BE IT FURTHER RESOLVED that the fee to accompany applications
for placement on the waiting list shall be fifty dollars ($50.00).
