HomeMy WebLinkAbout90-114 - Destruction of Police RecordsRESOLUTION NO. 90 -114 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING DESTRUCTION OF CERTAIN POLICE DEPARTMENT RECORDS. WHEREAS, Government Code Section 34090 provides that with the approval of the City Council by resolution and the written consent • of the City Attorney, the head of a City Department may destroy any City record, document, instrument, book or paper, under his charge, without making a copy after the same is no longer required; and WHEREAS, the Newport Beach Police Department currently maintains thousands of. files containing documents ten to twenty years old; and WHEREAS, it has been determined that many files contain documents and information no longer valuable to the Newport Beach Police Department or of interest to the Department of Justice and which are no longer required to be maintained pursuant to any other law or statute. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach as follows: 1. Documents meeting the below described criteria may be destroyed as directed by the Chief of Police, without making a copy and no longer maintained by the Newport Beach Police Department: a. Documents recording misdemeanor arrests ten years old or older unless such arrest is for a sex crime and provided that no activity has occurred relative to the arrest during those years. b. Documents recording felony arrests that are ten • years old or older, provided that no activity has occurred during those years. Felony arrests for sex crimes, homicides and robberies or other felonies subject to Penal Code Section 799 are excluded. 1 C. Misdemeanor crime reports which are ten years old or older. d. Felony crime reports which are ten years old or older. e. Stored /impounded vehicle reports that are two • years old or older. f. Found property reports that are two years old or older.
