A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ADOPTING FILING FEES FOR
ENVIRONMENTAL DOCUMENTS TO DEFRAY COSTS OF
DEPARTMENT OF FISH AND GAME FILING FEES
AUTHORIZED BY AB 3158
WHEREAS, Assembly Bill 3158 established filing fees for Notices of
Determination to defray the costs incurred by the Department of Fish and Game in the
• review of said documents; and
WHEREAS, the legislation allows local agencies to pass these costs on to
project proponents; and
WHEREAS, the legislation became effective January 1, 1991, and the fees
established are applicable to projects already in process; and
WHEREAS, the fees established herein are as specified by AB 3158.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Newport Beach that the following fees shall be paid by project proponents at the time an
environmental document is requested which requires the review of the Department of Fish
and Game:
1. All projects statutorily exempt from the California Environmental
Quality Act (CEQA) shall pay no fee.
2. All projects categorically exempt by regulations of the Secretary of
Resources from the requirement to prepare an environmental
document shall pay no fee.
3. All projects found by the lead agency to be de minimus in their effect
on the environment pursuant to the Department of Fish and Game
Guidelines for the implementation of AB 3158 shall pay no fee.
4. All projects for which a Negative Declaration has been prepared
pursuant to Section 21080(C) of the Public Resources Code shall pay
a fee of $1,250.00.
S. All projects for which an Environmental Impact Report has been
prepared pursuant to Section 21151 of the Public Resources Code shall
pay a fee of $850.00.
BE IT FURTHER RESOLVED that the aforementioned schedule of fees shall
become effective immediately, in order to protect the City from developer - related costs
• which may result from the requirements of the legislation.
