A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH INCREASING MUNICIPAL PARKING
VIOLATION PENALTIES TO COVER SURCHARGE PAYABLE
TO COUNTY OF ORANGE FOR CRIMINAL JUSTICE
FACILITIES AND COURTHOUSE FACILITIES
CONSTRUCTION AS REQUIRED BY STATE LAW.
0 WHEREAS, during the 1991 Legislative Session of the State of

California, AB544, SB21 and SB2142 amended Government Code Section
76000. In its final form, Section 76000 authorizes each county to
establish two funds for courthouse facilities construction pursuant
to Government Code Sections 76100 and 76101. As part of this
authorization, for every parking offense where a parking penalty,
fine or forfeiture is imposed, an added penalty of $2.50 shall be
included in the total penalty fine or forfeiture for each
authorized fund; and
WHEREAS, the City of Newport Beach has imposed a surcharge of
$2.00 since 1982 pursuant to Penal Code Section 1206.8, which was
subsequently amended and re- numbered as Government Code Section
76000; and
WHEREAS, Newport Beach City Council finds it is necessary to
increase the parking violation surcharge an additional $3.00 to
cover the entire $5.00 surcharge which will be required as of
November 30, 1991.
NOW, THEREFORE, BE IT RESOLVED as follows:
That a surcharge of $3.00 shall be imposed for all parking
violations for Title 12 of the Newport Beach Municipal Code and a
surcharge of $5.00 be imposed upon all violations of Chapter 12.46
of the Newport Beach Municipal Code related to handicapped parking.
