HomeMy WebLinkAbout91-112 - Vacation & Abandonment Glen DriveRESOLUTION NO. 91 -112 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING CITY'S INTENTION TO VACATE AND ABANDON A PORTION OF GLEN DRIVE FROM THE NORTHEASTERLY BOUNDARY OF LOT 68, TRACT 673 TO THE SOUTHERLY BOUNDARY OF LOT 40, TRACT 673 WHEREAS, the City Council of the City of Newport Beach, pursuant to the provisions of the Street Vacation Act (Section 8300 • et sec. of the Streets & Highways Code) is authorized to vacate public easements; and WHEREAS, the City Council of the City of Newport Beach intends to vacate a portion of the street legally described on Exhibit "A" and depicted on a map attached as Exhibit "B ", the vacation to be processed pursuant to the provisions of the Street Vacation Act; and WHEREAS, the City Council of the City of Newport Beach has reviewed and considered the various elements of the General Plan of the City of Newport Beach prior to declaring its intent to vacate this portion of street and has determined that the proposed vacation is consistent with the General Plan. NOW, THEREFORE, be it resolved by the City Council of the City of Newport Beach that the time and place for hearing all persons interested in, objecting to, the proposed vacation of this street legally described on Exhibit "A" and depicted on Exhibit "B", shall be at 7:00 p.m. or as soon thereafter as the matter may be heard on January 13, 1992, in the Chambers of the City Council of the City of Newport Beach located at 3300 Newport Boulevard, Newport Beach, California; and BE IT FURTHER RESOLVED that this resolution of intention shall be published for at least two (2) successive weeks prior to the hearing in the official newspaper of the City of Newport Beach; and BE IT FURTHER RESOLVED, that at least two (2) weeks before the day set for hearing, notices of the proposed vacation shall be conspicuously posted along Hazel Drive and Evening Canyon Drive, with the notices to be posted not more than three hundred feet (3001) apart and a minimum of three (3) notices posted. A notices shall also be posted on Glen Drive at East Coast Highway and on Glen Drive at Little Corona Beach near the Pacific Ocean. The notices shall state the day, hour, and place of the hearing and refer to the adoption of the Notice of Intention. • Adopted this 9th day of December ,1991. That certain portion of Glen Drive, 30.00 feet wide, in the City of Newport Beach, County of orange, State of California, as shown on a map of Tract No. 673, filed in Book 20, Pages 17 and 18 of Miscellaneous Maps, in the office of the Recorder of said County, said certain portion of Glen Drive being more particularly described as follows: Beginning at the most southerly corner of Lot 68, Block A, of said tract; thence S 15047130" E along the southeasterly prolongation of the northeasterly line of said lot, a distance of 33.93 feet to a point in that certain course having a bearing and length of N 79 022130" W 199.92 feet on the Right of Way line of said Glen Drive; thence westerly along said Right of Way and following the same in all its various courses and curves to the northwesterly corner of Lot 73, Block A of said tract; thence northwesterly in a direct line to the most southerly corner of Lot 40, Block A of said tract; thence northeasterly along the northwesterly Right of Way and following the same in all its various courses and curves to the Point of Beginning. RESERVING from the vacation of said portion of said street an easement for drainage purposes. .
