RESOLUTION NO. 92 -113
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AFFIRMING THE CATEGORICAL
EXEMPTION FOR ASSESSMENT DISTRICT NO. "
WHEREAS, the City of Newport Beach has received a petition from owners of
certain property on Balboa Peninsula to form a special assessment district for the purpose
of undergrounding utilities; and
WHEREAS, the City Council has reviewed the project for compliance with the
California Environmental Quality Act (California Public Resources Code Sec. 21000 et seq.)
and the CEQA Guidelines (Cal. Code of Regulations Sec. 15000 et seq.); and
WHEREAS, the City Council of the City of Newport Beach conducted a public
hearing on October 12, 1992 to receive and consider public testimony with respect to the
proposed project and its environmental documentation.
NOW, THEREFORE, BE IT RESOLVED that the City Council finds that
Assessment District No. 66 is Categorically Exempt (Class 2) from CEQA under the
provisions of Sec. 15302 of the CEQA Guidelines for replacement or reconstruction of
existing facilities.
