HomeMy WebLinkAbout93-12 - Seaward Seventeen AnnexationRESOLUTION NO. 93 -12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO APPROVE THE SEAWARD SEVENTEEN ANNEXATION AND DESIGNATING THE TERRITORY AS UNDEVELOPED PROPERTY PURSUANT TO THE MASTER PROPERTY TAX TRANSFER AGREEMENT BETWEEN THE COUNTY OF ORANGE AND THE CITY OF NEWPORT BEACH • WHEREAS, the logical formation and the deteimination of the boundaries of the City of Newport Beach is an important factor in the orderly development of the City; and WHEREAS, the extension of the logical boundaries of the City is appropriate; and WHEREAS, the distinctive short -form designation assigned by the City of Newport Beach to the territory proposed to be annexed is: Seaward Seventeen to the City of Newport Beach; and WHEREAS, said territory proposed to be annexed to the City of Newport Beach consists of approximately 1.22 acres of land, and the exterior boundaries thereof are specifically described in the legal description attached hereto, marked Exhibit A, and by this reference made a part thereof; and WHEREAS, that certain Master Property Tax Transfer Agreement between the County of Orange and the City of Newport Beach dated October 28, 1980 provides that the County of Orange and the City of Newport Beach shall agree, in writing, as to whether said territory to be annexed shall be deemed developed or undeveloped property for the purpose of transfer of property taxes, pursuant to Section 99(b) of the Revenue and Taxation Code of the State of California; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the Local Agency Formation Commission of the County of orange is hereby requested to approve • the annexation of certain uninhabited territory designated as Seaward Seventeen to the City of Newport Beach; and • • BE IT FURTHER RESOLVED by the City Council of the City of Newport Beach that, pursuant to the provisions of paragraph 6a(1)(d) of that certain Master Property Tax Transfer Agreement between the County of Orange and the City of Newport Beach dated October 28, 1980 that said territory to be annexed to the City of Newport Beach shall be deemed and treated as "undeveloped" property, for the purpose of compliance with said agreement.
