A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH SUMMARILY VACATING A PORTION OF AN EASEMENT FOR
PEDESTRIAN AND BICYCLE TRAILS, LANDSCAPING, WATER LINES
AND APPURTENANCES AT LOT A, TRACT 7844 LOCATED ADJACENT TO
SAN JOAQUIN HILLS ROAD EASTERLY OF SPY GLASS ROAD IN THE
SPY GLASS HILL AREA.
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of Chapter 4 of the Street Vacation Act
(Section 8330 et sea. of the Streets and Highways Code) is
authorized to vacate public service easements; and
WHEREAS, the City Council of the City of Newport Beach
intends to vacate a portion of the pedestrian and bicycle trails,
landscaping, water lines and appurtenances easement legally
described as Lot A, Tract 7844, and depicted on a map attached as
Exhibit "A ", the vacation to be processed pursuant to the
provisions of Chapter 4, commencing with Section 8330 of the Street
Vacation Act; and
WHEREAS, this pedestrian and bicycle trail, landscaping,
water lines and appurtenances easement has not been used for the
purposes for which it was dedicated for at least five years
preceding this vacation; and
WHEREAS, no public facilities have been located within
the easements and the City of Newport Beach has no future plans to
use the easement.
NOW, THEREFORE, be it resolved by the City Council of the
City of Newport Beach that the portion of pedestrian and bicycle
trails, landscaping, water lines and appurtenances easement legally
described as Lot A, Tract 7844, located adjacent to San Joaquin
Hills Road easterly of Spy Glass Road in the Spy Glass Hill area,
and depicted on Exhibit "A ", is hereby ordered vacated and no
longer constitutes a public service easement.
BE IT FURTHER RESOLVED that the City Clerk be and hereby
is ordered to cause a certified copy of this Resolution, attested
by the Clerk under Seal of the City of Newport Beach, to be
• recorded in the office of the County Recorder of the County of
Orange.
