A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH RELATIVE TO THE FILING OF
ARGUMENTS AND REBUTTALS FOR THE MEASURE TO BE
SUBMITTED TO THE VOTERS AT THE SPECIAL
MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 2,
1993.
• WHEREAS, the City Council of the City of Newport Beach has
called and given notice of a Special Municipal Election to be held
on November 2, 1993; and
WHEREAS, the City Council has determined to submit an advisory
measure to the voters on that date; and
WHEREAS, Sections 4015.5 and 5014.5 of the Elections Code of
the State of California authorize the City Council, by majority
vote, to adopt provisions and procedures for the filing of
arguments and rebuttals for City measures submitted to the voters
at any municipal election.
WHEREAS, the Elections Code establishes a procedure for
selecting arguments if more than one is filed and gives the City
Council or Council members priority if the argument was authorized
by the legislative body.
WHEREAS, July 13, 1993 the Newport Beach city Council adopted
the provisions of section 5014.5a of the elections code of the
State of California and the provisions of that section shall apply
to the Special Municipal Election to be held on November 2, 1993.
NOW, THEREFORE, BE IT RESOLVED, DECLARED, DETERMINED AND
ORDERED by the City Council of the City of Newport Beach as
• follows:
Section 1. The Mayor pro tem is hereby authorized to sign,
on behalf of herself, and those members of the City Council who

consent in writing, an argument in support of the advisory measure
relating to the formation of a city -wide assessment district to
acquire, improve, and maintain to large parcels of vacant land
known as Castaways and Newporter North.
Section 2. The Mayor pro tem is also authorized to author
• and sign, on behalf of those who endorse the argument in favor of
the advisory measure, a rebuttal to any argument against the
•
measure.
Section 3. That the City Clerk shall certify to the
passage and adoption of this Resolution and enter it into the book
of original resolutions.
