A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DIRECTING THE CITY ATTORNEY
TO PREPARE AN IMPARTIAL ANALYSIS OF THE
ADVISORY MEASURE TO BE SUBMITTED TO THE VOTERS
AT THE SPECIAL MUNICIPAL ELECTION TO BE HELD
ON NOVEMBER 2, 1993.
WHEREAS, the City Council of the City of Newport Beach has
called a Special Municipal Election to be held on November 2, 1993,
for the purpose of submitting an advisory measure to the electorate
regarding the desirability of forming a city -wide assessment
district to finance the purchase, maintenance, and improvement, for
recreational and environmental open space of two large vacant
parcels of land known as Castaways and Newporter North; and
WHEREAS, section 5011 of the elections code provides that the
City Council may direct the city attorney to prepare an impartial
analysis of any measure; and
WHEREAS, the advisory measure relating to the proposed
formation of an assessment district to acquire open space is
relatively complex and additional information regarding the matter
will help insure that voters are fully informed.
NOW, THEREFORE, BE IT RESOLVED, DECLARED, DETERMINED AND
ORDERED by the City Council of the City of Newport Beach as
follows:
Section 1. The City Clerk is hereby directed to transmit a
copy of the advisory measure to the City Attorney.
• Section 2. The City Attorney is directed to prepare an
impartial analysis of the measure with an emphasis on a complete
description of the parcels proposed to be acquired, the nature and
location of the active recreational facilities, and the financial
impact on property owners of forming the district.
