A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING AN AGREEMENT WITH
WEST COAST ARBORISTS, INC., FOR CITY TREE
TRIMMING SERVICES.
•WHEREAS, the City Council has determined that it is in the
public interest to enter into a Contract with private business to
provide maintenance services for City owned trees;
WHEREAS, the City Council has approved a Memorandum of
Understanding with the City of Newport Beach Employees League,
which resolves the effects of privatization of the City's street
tree maintenance operations;
WHEREAS, Section 421 of the Newport Beach City Charter
authorizes the City Council to authorize the City Manager to bind
the City with a written Contract for the acquisition of services
included within the budget approved by the City Council. The
authorization may impose a monetary limit on the City Manager's
authority;
WHEREAS, the City policy and purchasing procedures authorize
the Council to waive formal bidding procedures for contracts which
provide services to the City;
WHEREAS, in January, 1993, the City of Tustin developed bid
specifications and solicited bids to qualified business entities
which offer tree maintenance services to provide such services for
the City of Tustin;
WHEREAS, the City of Tustin awarded a Contract to West Coast
Arborists, Inc., as the lowest responsible bidder;
WHEREAS, West Coast Arborists, Inc., has offered to the City
of Newport Beach the same terms, conditions, and costs to perform
the tree maintenance services as the Contract awarded pursuant to
• formal bidding procedures by the City of Tustin;
WHEREAS, the City Council determines that in approving the
Contract with the same cost for services as obtained through the
City of Tustin bidding process is the most cost efficient and time
saving manner to obtain tree maintenance services, for the City of
Newport Beach;
WHEREAS, West Coast Arborists, Inc., are shown to have the
necessary high quality specialized expertise to meet the City's
tree maintenance needs;
WHEREAS, City proposes to enter into a one year Agreement with
West Coast Arborists, Inc., which may be extended for up to four
• years, to perform City tree maintenance service for the City,
commencing January, 1, 1994, for the total annual amount of
$348,540.00;
WHEREAS, it has been shown that the amount for the acquisition
of services is included within the approved 1993 -94 Fiscal Year
Budget;
NOW, THEREFORE, the City Council of the City of Newport Beach
does resolve as follows:
1. That the proposed Contractor Agreement with West Coast
Arborists, Inc., attached hereto as Exhibit A, is hereby approved
and the City Manager is authorized to execute the Contract on
behalf of the Newport Beach.
