HomeMy WebLinkAbout94-105 - Nondisposal Facility Element• • RESOLUTION NO. 94- 105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADOPTING A NONDISPOSAL FACILITY ELEMENT PURSUANT TO THE REQUIREMENTS OF THE PUBLIC RESOURCES CODE. WHEREAS, the California Integrated Waste Management Act of 1989 (AB 939) requires cities and counties to develop and implement solid waste management plans to describe how state - mandated solid waste reduction goals will be met; and WHEREAS, the City of Newport Beach adopted its final Source Reduction and Recycling Element (SRRE) in January 1992, and Household Hazardous Waste Element (HHWE) in July 1992, both in compliance with AB 939 regulations and after review by the AB 939 Local Task Force and the California Integrated Waste Management Board; and WHEREAS, Public Resources Code Section 41730 requires each city to prepare and adopt a Nondisposal Facility Element which identifies any new facilities and the expansion of existing facilities which will be needed to implement the city's SRRE; and WHEREAS, the City's Nondisposal Facility Element describes contemplated use of current facilities located in other jurisdictions, the expansion of some of those facilities, and the construction of new solid waste facilities; and WHEREAS, no environmental review of the Nondisposal Facility Element is required by law; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the Nondisposal Facility Element is hereby adopted.
