HomeMy WebLinkAbout2010 - 31 - Small Craft Boat Harbor Development LoanRESOLUTION NO. 2010-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE CITY MANAGER TO REQUEST A SMALL CRAFT BOAT HARBOR DEVELOPMENT LOAN FROM THE CALIFORNIA DEPARTMENT OF BOATING AND WATERWAYS WHEREAS, the City of Newport Beach ( "City ") has adopted a General Plan that contains a Harbor and Bay Element, and a Coastal Land Use Plan, which include policies that encourage the expansion and improvement of public access to water uses and encourage new and improved facilities and services for visiting vessels; and WHEREAS, a recent study by the City's Harbor Commission identified the need for 45 to 50 additional berths for small recreational vessels visiting Newport Harbor; and WHEREAS, the lack of adequate berths for visiting boaters restricts the use of Newport Harbor to boaters who have the experience, ability and vessel characteristics that allow them to use moorings, and discourages aging, physically handicapped and less experienced boaters from visiting Newport Harbor; and WHEREAS, the City intends to construct the Marina Park Project ( "Project "), located on Lower Newport Bay between 15th and 18th Streets, to include a new marina consisting of 23 slips and one side -tie to accommodate short-term visits by recreational vessels and storage of recreational vessels associated with the sailing center component of the Project; and WHEREAS, the City desires to apply for a Small Craft Boat Harbor Development Loan from the California Department of Boating and Waterways to assist with construction of the marina portion of the Project; and WHEREAS, the City estimates construction of the marina will cost $8,300,000 and construction of the total Project will cost $20,000,000; and the City is seeking a loan only for costs associated with construction of the marina; and WHEREAS, the City is committed to completing the Project and providing additional facilities for visiting vessels, but is constrained in its ability to do so with local resources, because of pressing needs to replace other critical public infrastructure and facilities, including fire stations and police facilities; NOW, THEREFORE, be it resolved by the City Council of the City of Newport Beach as follows: 1 Section 1. The City hereby requests a Small Craft Boat Harbor Development Loan from the California Department of Boating and Waterways, in an amount up to Eight Million, Three Hundred Thousand Dollars ($8,300,000). The purpose of the loan is to facilitate construction of the marina portion of the Marina Park Project, consisting of 23 slips and one side -tie to accommodate short -term visits by recreational vessels and storage of recreational vessels associated with the sailing center component of the Project. Section 2. The City Manager is hereby designated as the City's representative authorized to accept the loan, sign the loan agreement, and to carry out the intent of this Resolution. Section 3. The City understands that the berthing in the proposed marina may be operated either publicly or privately. The City has not decided on the method of operation, but will consider both public and private methods before the marina becomes operational. Adopted this 23rd day of March, 2010.
