HomeMy WebLinkAbout2011-12 - Buck Gully Resoration - MNDRESOLUTION NO. 2011 -12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADOPTING A MITIGATED NEGATIVE DECLARATION FOR THE BUCK GULLY RESTORATION PROJECT WHEREAS, an Initial Study and Mitigated Negative Declaration have been prepared in compliance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and City Council Policy K -3; and WHEREAS, the draft Mitigated Negative Declaration was circulated for a 30 -day comment period beginning on October 19, 2010 and ending November 17, 2010. The contents of the environmental document and comments on the document were considered by the City Council in its review of the proposed project; and WHEREAS, on the basis of the entire environmental review record, the proposed project, with mitigation measures, will have a less than significant impact upon the environment and there are no known substantial adverse affects on human beings that would be caused. Additionally, there are no long -term environmental goals that would be compromised by the project, nor cumulative impacts anticipated in connection with the project. The mitigation measures identified and incorporated in the Mitigation Monitoring and Reporting Program are feasible and will reduce the potential environmental impacts to a less than significant level; and RESOLVED, that the City Council of the City of Newport Beach does hereby find, on the basis of the whole record, that there is no substantial evidence that the project, with mitigation measures, will have a significant effect on the environment, and that the Mitigated Negative Declaration reflects the City Council's independent judgment and analysis. The City Council hereby adopts the Mitigated Negative Declaration and the Mitigation Monitoring and Reporting Program attached as Exhibit A. The document and all material, which constitutes the record upon which this decision was based, are on file with the Public Works Department, 3300 Newport Boulevard, Newport Beach, California. Henn Mayor oa'e I°OR @ City of Newport Beach Buck Gully Restoration Project u i EXHIBIT A Initial Study /Mitigated Negative Declaration C'P<IF00.��P 3.0 MITIGATION MONITORING AND REPORTING INTRODUCTION CEQA requires that when a public agency completes an environmental document, which includes measures to mitigate or avoid significant environmental effects, the public agency must adopt a reporting or monitoring program. This requirement ensures that environmental impacts found to be significant will be mitigated. The reporting or monitoring program must be designed to ensure compliance during project implementation (Public Resources Code Section 21081.6). In compliance with Public Resources Code Section 21081.6, the attached Section 4.0, Mitigation Monitoring and Reporting Checklist, has been prepared for the Buck Gully Restoration Project. This Mitigation Monitoring and Reporting Checklist is intended to provide verification that all applicable Conditions of Approval relative to significant environmental impacts are monitored and reported. Monitoring will include: 1) verification that each mitigation measure has been implemented; 2) recordation of the actions taken to implement each mitigation; and 3) retention of records in the Buck Gully Project file. This Mitigation Monitoring and Reporting Program delineates responsibilities for monitoring the Buck Gully Restoration Project, but also allows the City flexibility and discretion in determining how best to monitor implementation. Monitoring procedures will vary according to the type of mitigation measure. Adequate monitoring consists of demonstrating that monitoring procedures took place and that mitigation measures were implemented. This includes the review of all monitoring reports, enforcement actions, and document disposition, unless otherwise noted in the attached Mitigation Monitoring and Reporting Program Checklist. If an adopted mitigation measure is not being properly implemented, the designated monitoring personnel shall require corrective actions to ensure adequate implementation. Reporting consists of establishing a record that a mitigation measure is being implemented, and generally involves the following steps: • The City distributes reporting forms to the appropriate entities for verification of compliance. Departments /agencies with reporting responsibilities will review the Initial Study, which provides general background information on the reasons for including specified mitigation measures. Problems or exceptions to compliance will be addressed to the City as appropriate. Periodic meetings may be held during project implementation to report on compliance of mitigation measures. Responsible parties provide the City with verification that monitoring has been conducted and ensure, as applicable, that mitigation measures have been implemented. Monitoring compliance may be documented through existing review and approval programs such as field inspection reports and plan review. Appropriate mitigation measures will be included in construction documents and /or conditions of permits /approvals. Minor changes to the Mitigation Monitoring and Reporting Program, if required, would be made in accordance with CEQA and would be permitted after further review and approval by the City. Such changes could include reassignment of monitoring and reporting responsibilities, program redesign to make any appropriate improvements, and /or modification, substitution, or deletion of mitigation measures subject to conditions described in CEQA Guidelines Section 15162. No change will be permitted unless the Mitigation Monitoring and Reporting Program continues to satisfy the requirements of Public Resources Code Section 21081.6.
