The Condition of Approval <br />requires that use of an attic space over a garage be limited to storage only, <br />and that the storage area is not to be used as additional living space. The <br />applicant is requesting that the condition of approval be changed to allow the <br />area over the garage to be converted to living area and used as a home office. <br />SUGGESTED <br />ACTION: Approve, modify or deny: <br />• Modification Permit No. 4843 <br />LEGAL <br />DESCRIPTION: Lot 1, Block D, Corona del Mar Tract <br />ZONE: R -1 (Single Family Residential) <br />OWNER: Phil and Mary Rowe, Corona del Mar <br />DISCUSSION: <br />At its meeting of April 8, 1999, the Planning Commission upheld the decision of the Modification <br />Committee to require the area above the garage to be limited to storage use only, and not as living <br />space. The applicant "finished" the area above the garage by converting the storage area to living <br />space which was specifically prohibited by the Modification Committee. The conversion of the <br />storage area was done against the specific findings and conditions of Modification No. 4843 and <br />without the benefit of the appropriate permits. Since the Modification application did not include a <br />request to build living area over the garage and the applicant agreed to the condition of approval <br />limiting the area over the garage to storage, and found that use of the existing garage beyond <br />storage would worsen the existing unsafe traffic condition, the Planning Commission denied the <br />appeal. A copy of the staff report to the Planning Commission and an excerpt of the meeting <br />minutes are attached for the Council's review. <br />
