CITY OF <br />F NEWPORT REACH <br />" City Council Staff Report <br />November 25, 2014 <br />Agenda Item No. 4 <br />TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL <br />FROM: Kimberly Brandt, Community Development Director — (949) 644 -3226, <br />kbrandt@newportbeachca.gov <br />PREPARED BY: Seimone Jurjis, Chief Building Official <br />PHONE: (949) 644 -3282 <br />TITLE: Adopt Resolutions and Agreements for Inclusion of Properties within the City's <br />Jurisdiction in the Figtree and CaliforniaFirst Property Assessed Clean Energy <br />(PACE) Financing Programs <br />ABSTRACT: <br />California Assembly Bill (AB) 811 (July 21, 2008) and AB 474 (January 1, 2010) authorize Property <br />Assessed Clean Energy (PACE) financing whereby legislative bodies may designate areas within their <br />jurisdiction which willing property owners may enter into voluntary contractual assessments for the purpose <br />of financing the installation of distributed generation renewable energy sources such as solar panels, <br />energy efficiency improvement, and /or water conservation improvements that are permanently affixed to <br />real property. The City of Newport Beach currently participates in the PACE HERO program. The City has <br />been invited to participate in two additional PACE financing programs: Figtree Pace Program and <br />CaliforniaFirst. By joining these two PACE programs, the City can offer PACE financing to property owners <br />without impacting the City's budget, and foster a competitive market place. The City will not incur any cost <br />or involvement and there are no administrative responsibilities, marketing obligations, or financial exposure <br />to the City. <br />RECOMMENDATION: <br />a) Adopt Resolution No. 2014 -94, A Resolution of the City Council of the City of Newport Beach <br />Authorizing the City of Newport Beach to Join the Figtree PACE Program, and Authorizing the California <br />Enterprise Development Authority to Conduct Contractual Assessment Proceedings and Levy Contractual <br />Assessments within the Territory of the City of Newport Beach; <br />b) Approve an Associate Membership Agreement by and Between the California Enterprise Development <br />Authority and the City of Newport Beach; <br />c) Adopt Resolution No. 2014 -95, A Resolution of the City Council of the City of Newport Beach <br />Authorizing the City to Join the CaliforniaFIRST Program, and Authorizing the California Statewide <br />Communities Development Authority to Accept Applications from Property Owners, Conduct Contractual <br />Assessment Proceedings and Levy Contractual Assessments within the Territory of the City of Newport <br />Beach; and q -t <br />
