Cassidy, J.D., Deputy City Manager /HR Director <br />PHONE: (949) 644 -3303, tcassidy @newportbeachca.gov <br />TITLE: Amended and Restated Employment Agreements for the City Manager, City <br />Attorney and City Clerk <br />ABSTRACT: <br />The City of Newport Beach Charter, Articles V and VI, establishes the powers, duties and responsibilities <br />of City Council's three appointed positions, City Manager, City Attorney, and City Clerk, with the terms and <br />conditions of their employment defined by their respective Employment Agreements. From time to time, <br />the City Council and incumbents may renegotiate terms of employment, including adjustments to <br />compensation and /or benefits. During the Closed Session on November 15, 2014, the City Council <br />conducted preliminary performance reviews for the City Manager, City Attorney and City Clerk. During the <br />Closed Session on November 25, 2014, the City Council expects to complete the performance reviews <br />and may consider compensation changes at that time. Following the Closed Session, the Designated <br />Council Negotiator will report to the public any proposed changes in compensation or other amendments <br />to the Employment Agreements for the City Manager, City Attorney, and City Clerk, prior to taking any <br />action. <br />RECOMMENDATION: <br />The following actions are recommended, pending discussions during City Council Closed Session: <br />a) Authorize the Mayor to execute the Third Amended and Restated Employment Agreement between <br />the City of Newport Beach and Dave Kiff, City Manager, subject to those terms and conditions approved <br />by the City Council; <br />b) Authorize the Mayor to execute the Second Amended and Restated Employment Agreement between <br />the City of Newport Beach and Aaron Harp, City Attorney, subject to those terms and conditions approved <br />by the City Council; and <br />c) Authorize the Mayor to execute the Second Amended and Restated Employment Agreement between <br />the City of Newport Beach and Leilani Brown, City Clerk, subject to those terms and conditions approved <br />by the City Council. <br />
