RESOLUTION NO. 2014-101 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF NEWPORT BEACH, CALIFORNIA ESTABLISHING <br />FUNDING FOR THE AREA BENEFIT DISTRICT RESERVE <br />(PA2014 -016) <br />WHEREAS, it has been a long- standing goal of the City of Newport Beach <br />( "City ") to revitalize Balboa Village and to expand its vibrant commercial village serving <br />both visitors and residents; <br />WHEREAS, in 2012, the City evaluated the area to establish policies and <br />programs to spur economic activity and manage existing parking, which resulted in the <br />adoption of the Balboa Village Master Plan ( "Master Plan "); <br />WHEREAS, the Master Plan established a comprehensive strategy for <br />revitalization of the Balboa Village and identified the need 'to establish a dedicated <br />funding mechanism to implement the various programs identified in the Master Plan; <br />WHEREAS, the Balboa Village Advisory Committee ( "BVAC ") held monthly <br />public meetings between December 2013, and January 2014, that provided a forum for <br />public participation where implementation of the Master Plan, including the potential use <br />of parking revenues to support the various strategies within the Master Plan, were <br />discussed; <br />WHEREAS, on January 8, 2014, the BVAC voted to recommend the City Council <br />create a parking benefit district for Balboa Village; <br />WHEREAS, on November 25, 2014, the City Council introduced Ordinance <br />No. 2014 -21 to amend Newport Beach Municipal Code ( "NBMC ") Chapter 12.44 by <br />adding Section 12.44.029, creating the Area Benefit District Reserve and the Balboa <br />Village Area Benefit District; and <br />WHEREAS, NBMC Section 12.44.029 provides the City Council may direct <br />revenue into the Area Benefit District Reserve by resolution. <br />NOW, THEREFORE, the City Council of the City of Newport Beach hereby <br />resolves as follows: <br />Section 1: One hundred percent (100 %) of all on- street and off - street parking <br />fees and revenue generated by the City within the Balboa Village Area Benefit District, <br />including, but not limited to, parking lot lease revenue, pay stations, and parking meters, <br />with the exception of tidelands fees or revenues, shall be deposited into the Area <br />Benefit District Reserve to be used consistent with NBMC Section 12.44.029. <br />Section 2: The City Council finds the adoption of this resolution is not subject <br />to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) <br />(the activity will not result in a direct or reasonably foreseeable indirect physical change <br />
