HomeMy WebLinkAbout2014-101 - Establishing Funding for the Area Benefit District Reserve (PA2014-016)RESOLUTION NO. 2014-101 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA ESTABLISHING FUNDING FOR THE AREA BENEFIT DISTRICT RESERVE (PA2014 -016) WHEREAS, it has been a long- standing goal of the City of Newport Beach ( "City ") to revitalize Balboa Village and to expand its vibrant commercial village serving both visitors and residents; WHEREAS, in 2012, the City evaluated the area to establish policies and programs to spur economic activity and manage existing parking, which resulted in the adoption of the Balboa Village Master Plan ( "Master Plan "); WHEREAS, the Master Plan established a comprehensive strategy for revitalization of the Balboa Village and identified the need 'to establish a dedicated funding mechanism to implement the various programs identified in the Master Plan; WHEREAS, the Balboa Village Advisory Committee ( "BVAC ") held monthly public meetings between December 2013, and January 2014, that provided a forum for public participation where implementation of the Master Plan, including the potential use of parking revenues to support the various strategies within the Master Plan, were discussed; WHEREAS, on January 8, 2014, the BVAC voted to recommend the City Council create a parking benefit district for Balboa Village; WHEREAS, on November 25, 2014, the City Council introduced Ordinance No. 2014 -21 to amend Newport Beach Municipal Code ( "NBMC ") Chapter 12.44 by adding Section 12.44.029, creating the Area Benefit District Reserve and the Balboa Village Area Benefit District; and WHEREAS, NBMC Section 12.44.029 provides the City Council may direct revenue into the Area Benefit District Reserve by resolution. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: One hundred percent (100 %) of all on- street and off - street parking fees and revenue generated by the City within the Balboa Village Area Benefit District, including, but not limited to, parking lot lease revenue, pay stations, and parking meters, with the exception of tidelands fees or revenues, shall be deposited into the Area Benefit District Reserve to be used consistent with NBMC Section 12.44.029. Section 2: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly, and it only establishes funding priorities. Section 3: The recitals provided in this resolution are true and correct and are hereby incorporated into the substantive portion of this resolution. Section 4: This resolution shall take effect on the effective date of Ordinance No. 2014 -21 amending NBMC Chapter 12.44 and creating the Area Benefit District Reserve and the Balboa Village Area Benefit District.
