HomeMy WebLinkAbout2014-102 - Establishing a Revised Schedule of Parking Fees for Off-Street Parking Meter Zones 17, 18, 23, 28, and 29 Located in Balboa Village (PA2014-016)RESOLUTION NO. 2014 -102 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA ESTABLISHING A REVISED SCHEDULE OF PARKING FEES FOR OFF - STREET PARKING METER ZONES 17, 18, 23, 28, AND 29 LOCATED IN BALBOA VILLAGE (PA2014 -016) WHEREAS, California Vehicle Code Sections 22508 and Newport Beach Municipal Code ( "NBMC") Section 12.44.030 authorize the City Council of the City of Newport Beach ( "City ") to establish off - street parking meter zones by resolution; WHEREAS, the City Council adopted Resolution No. 2000 -38 establishing, in part, off - street parking meter zones 17, 18, 23, and 28, and the hours of operation and parking meter fees for each of the zones; WHEREAS, the City Council adopted Resolution No. 2010 -39 establishing a revised parking meter fee schedule for the parking meter zones created by Resolution No. 2000 -38, since the parking meter fees had not been adjusted since the year 2000; WHEREAS, the City Council adopted Resolution No. 2013 -33 that established, in part, off - street parking meter Zone 29, commonly known as the Balboa Pier Parking Lot, and established parking meter fees and hours of use for said zone; WHEREAS, the City Council adopted Resolution No. 2014 -16 amending Resolution No. 2013 -33 to modify the parking fees to be consistent with Coastal Development Permit No. 5 -13 -0506; WHEREAS, it has been a long- standing goal of the City of Newport Beach ( "City') to revitalize Balboa Village and to expand its vibrant commercial village serving both visitors and residents; WHEREAS, in 2012, the City evaluated the area to establish policies and programs to spur economic activity and manage existing parking, which resulted in the adoption of the Balboa Village Master Plan; WHEREAS, the Balboa Village Master Plan established a comprehensive parking strategy to better manage existing parking resources and proposed , the modification of both on- street and off - street parking fees to influence parking behavior to promote more efficient use of existing parking facilities and provide incentives for longer -term parking to occur in off - street lots; WHEREAS, studies prepared by Nelson /Nygaard, a transportation consultant, showed that the existing one -hour parking limits were insufficient for many trips to area businesses and that the current fee structure was not providing a sufficient incentive to promote increased turnover of vehicles; Resolution No. 2014 -102 Page 2 of 4 WHEREAS, the Balboa Village Advisory Committee ( "BVAC ") held monthly public meetings between December 2013, and January 2014, that provided a forum for public participation where implementation of the Balboa Village Master Plan and the recommendations of Nelson /Nygaard, including changes to parking fees, were discussed; WHEREAS, on January 8, 2014, the BVAC voted to recommend City Council adoption of the parking fee structure contained in this resolution; WHEREAS, the City Council finds that all parking meter fees in Balboa Village should be modified to promote more efficient use of the parking spaces by establishing a fees for both the peak summer season and the non -peak season; WHEREAS, the City Council further finds, the increase in fees for on- street spaces along with a decrease in fees for off - street parking lots will provide an incentive for longer -term parking to occur in the larger off - street lots; WHEREAS, the revenue generated from the parking meter fees funds a number of important items within the City, including but not limited to traffic control, parking management, installation and maintenance of parking meters, recreational activities, beautification projects, and related improvements; and WHEREAS, California Vehicle Code Section 22508 further authorizes the City to establish fees for parking meter zones and allows fees to be variable based upon criteria identified by the City. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: The fees for parking at parking meters in off - street parking meter Zones 17, 18, 23, and 28, said zones established by Resolution No. 2000 -38, shall be fifty cents ($0.50) per hour during the non -peak season and one dollar and fifty cents ($1.50) per hour during the peak season when the meters are in o eration. The non - peak season is defined as period between October 1st and April 30t of each year and the peak season is defined as the period between May 15t and September 30th of each year. Section 2: The hours of operation for all parking meters in off - street parking meter Zones 17, 18, 23, and 28 shall remain 8:00 a.m. to 6:00 p.m. daily, as provided in Resolution No. 2000 -38. Resolution No. 2014 -102 Page 3 of 4 Section 3: The fees for parking at parking meters in off- street parking meter Zone 29, said zone established by Resolution No. 2013 -33 and amended by Resolution No. 2014 -16, shall be as follows: The non -peak season is defined as period between October 15t and April 30th of each year and the peak season is defined as the period between May 15t and September 30th of each year. Peak Federal holidays are Memorial Day, Fourth of July and Labor Day. Federal holiday fee shall only apply on the actual Federal holiday and do not apply to the holiday week or weekend. Pursuant to Coastal Development Permit No. 5 -13 -0506, the City Manager may annually increase or decrease Zone 29 hourly and daily maximum parking fees by no more than 25 %, not to exceed 50% in 3 consecutive years. Any increase in parking fee shall be reported to the Executive Director of the California Coastal Commission. Section 4: The hours of operation for parking payment centers or parking meters in off - street parking meter Zone 29 shall remain 24 hours a day, 365 days a year, as provided in Resolution No. 2013 -33. Section 5: The City Manager is authorized to waive the aforementioned fees established herein for Zone 29 when a special event of a charitable or civic nature is being held and it is in the best interest of the City and the general public that fees not be charged for the use of any such parking lot in connection with said special event. Section 6: The revised fee schedule represents a reduction in fees for Zone 29 and is consistent with the provisions of Coastal Development Permit No. 5 -13 -0506. Section 7: Section 1 and Section 2 of Resolution No. 2014 -16 are hereby repealed on the effective date of this resolution. Section 8: Notwithstanding any resolution or provision to the contrary, payment for parking meters, parking pay stations or similar devices in all zones, may be in U.S. coins, U.S. dollars, credit card, electronic payment or as otherwise accepted by the parking meter, parking pay station or similar device. Resolution No. 2014 -102 Page 4 of 4 Section 9: Except as expressly modified herein, all other provisions, terms, and covenants set forth in the resolutions referenced herein shall remain unchanged and shall be in full force and effect. Section 10: The City Council finds that the establishment of parking meter regulations and parking meter fees is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. This resolution does not authorize development and it only modifies parking meter fees at existing meters. Section 11: The recitals provided in this resolution are true and correct and are hereby incorporated into the substantive portion of this resolution. Section 12: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
