RECOMMENDATION 1. Adopt Resolution 2007 -_ forming the City Council Ad Hoc Development Agreement Committee. 2. Confirm the Mayor's appointment of up to three Council Members. DISCUSSION The Newport Beach Country Club submitted an application for a Planned Community Development Plan, which includes the development of 32 housing units (5 single - family dwelling units and 27 short-term rental units) that would be drawn from the 450 dwelling units allocated for Newport Center in the General Plan. Policy LU 6.14.8 requires the execution of development agreements for residential and mixed -use projects that use this allocation. Development agreements are required to define the improvements and benefits to be contributed by the developer in exchange for the City's commitment for the number, density, and location of the housing units. Staff is seeking guidance from the City Council on the terms and conditions of such an agreement. Staff, therefore, recommends a formation of a short-term ad hoc committee to ensure that adequate public benefits will be provided. The committee members would be appointed by the Mayor and could be comprised of up to three Council Members. Newport Beach Country Club May 8, 2007 Page 2 Environmental Review The formation of an ad hoc committee is not a project as defined by the California Environmental Quality Act; therefore, no environmental review is required. Public Notice No public notice is required for this consideration; however, this item is on the City Council Agenda, which is posted at City Hall, and is also available on the City's web site.
