PADDLE AND BODY BOARDS DONATION AGREEMENT
This AGREEMENT FOR DONATION OF PADDLE BOARDS ("Agreement") is
made this 14th day of June, 2016 by and between the NEWPORT BEACH JUNIOR
LIFEGUARD FOUNDATION ("Foundation") and the CITY OF NEWPORT BEACH, a
California municipal corporation and charter city ("City'). It is agreed between the
parties that:
1. Foundation agrees to donate, and City agrees to accept the following described
property ("Property") valued at approximately Six Thousand Five Hundred Three and
92/100 dollars ($6,503.92):
• One ten -foot (10') by sixteen -foot (16') stand-up inflatable paddle board
valued at approximately Four Thousand Three Hundred Ninety -Eight and
92/100 dollars ($4,398.92); and
• 25 custom printed body boards valued at approximately Two Thousand Once
Hundred Five and 00/100 dollars ($2,105.00).
2. The donated Property will be used only by City staff and then current registrants of
the Newport Beach Junior Lifeguard Program during the duration of the Newport
Beach Junior Lifeguard Program. The intended use will be for water safety
instruction, team building, competition and recreation by the Newport Beach Junior
Lifeguard participants and Newport Beach Junior Lifeguard staff.
3. The parties agree to transfer the Property on June 16, 2016.
4. Said Property is donated in "as is" condition and the Foundation disclaims any
warranty of merchantability or working order or condition of the Property except that
they shall be donated in their present condition. Foundation has not made any
representations or warranties, implied or express, relating to the condition of the
Property.
5. The parties agree that the Foundation will be released of all liability resulting from
the use, maintenance, storage or possession of the Property effective upon the Date
of Donation.
6. This Agreement shall be binding and inure to the benefit of the parties, their
successors, assigns and personal representatives.
