EMPLOYMENT AGREEMENT <br />CITY OF NEWPORT BEACH FIRE CHIEF <br />This EMPLOYMENT AGREEMENT ("Agreement") is made effective as of July 23, 2019 <br />("Effective Date") and is entered into by and between the CITY OF NEWPORT BEACH, <br />a California municipal corporation and Charter City ("Employer" or "City") and JEFF <br />BOYLES ("Employee"), an individual (sometimes collectively referred to herein as "the <br />Parties"). <br />RECITALS <br />A. City is a municipal corporation duly organized and validly existing under the laws of <br />the State of California with the power to carry on its business under the statutes of the <br />State of California and the City Charter. <br />B. Pursuant to Section 504(a) of the City Charter, and in accordance with Newport Beach <br />Municipal Code ("NBMC") Section 2.24.100, the City Manager has directed a <br />qualifications appraisal process and screened all qualified applicants and other <br />qualified persons known by the City Manager to be available for the position of Fire <br />Chief. <br />C. Following the qualifications appraisal process, the City Manager believes Employee <br />to be the best qualified on the basis of executive and administrative qualifications, with <br />special reference to the experience and knowledge of accepted practice with respect <br />to the duties of Fire Chief as contemplated by, and in conformity with, NBMC Section <br />2.24.100. <br />D. The City desires to employ Employee as Fire Chief and to enter into an Agreement <br />with Employee upon the terms and conditions in this Agreement. <br />E. Employee is willing to accept such employment on the terms and conditions set forth <br />in this Agreement. <br />F. The Parties also mutually agree that this form of Agreement reflects the terms and <br />conditions under which the Parties intend and desire to continue Employee's <br />employment, and that there are no other agreements between them - oral, written or <br />implied. <br />NOW, THEREFORE, it is mutually agreed by and between the undersigned Parties as <br />follows: <br />SECTION 1: Term and Notice of Non -Renewal <br />This Agreement shall become effective July 23, 2019 ("Effective Date").
