Brown, City Clerk APPROVED: -.ia A TITLE: APPOINTMENTS TO THE ENVIRONMENTAL QUALITY AFFAIRS COMMITTEE (EQAC) AND THE WATER QUALITY /COASTAL TIDELANDS MANAGEMENT COMMITTEE ABSTRACT: On November 27, 2012, the City Council adopted Resolution No. 2012 -115 which established the Water Quality /Coastal Tidelands Management Committee and adopted Resolution No. 2012 -116 which established the Environmental Quality Affairs Committee (EQAC). The City Council directed that appointments to both committees would occur in January 2013. RECOMMENDATION: a) Waive the portions of Council Policy A -2 (Board and Commission Appointments) which establishes a Council Ad Hoc Appointments Committee and requires two or more applications for each vacant seat. b) Consider the applications received in the City Clerk's Office by the January 9, 2013 deadline. c -1) Make appointments via paper ballot to EQAC and the Water Quality /Coastal Tidelands Management Committee pursuant to City Council Policy A -2. OR c -2) Postpone appointments until more applications are received. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. Appointments to EQAC and Water Quality /Coastal Tidelands Management Committee January 22, 2013 Page 2 DISCUSSION: The newly established EQAC and Water Quality /Coastal Tidelands Management Committee were adopted by the City Council at the November 27, 2012 City Council meeting. The purpose of Water Quality /Coastal Tidelands Management Committee is to improve and preserve the Newport Beach coastline and Newport Bay as a resource for recreational use and as healthy habitats. EQAC's purpose is to advise the City Council on policies, programs and projects that improve or detract from the environmental quality of the City, as requested by the City Council; comment on Notices of Preparation, as requested by the City Council; and will meet as needed to consider issues referred to them by the City Council. The City Clerk published the Notice of Vacancies in the Daily Pilot on Saturday, December 22, 2012; and on Monday, December 17, 2012, posted the Notice of Vacancies in the City Clerk's Office and the City Hall bulletin board, and placed the Notice of Vacancies on the City's webpage. The deadline to submit applications was Thursday, January 9, 2013. EQAC EQAC will be comprised of seven members from various geographical areas of the City appointed by the City Council and two non - voting Council Members appointed by the Mayor, subject to confirmation by the City Council. The Mayor will also appoint one of the two non - voting Council Members as the Chair of the committee. The City Council confirmed Mayor Curry's appointments to EQAC of Council Member Nancy Gardner (Chair) and Council Member Tony Petros at the January 8, 2013 City Council meeting. The seven members appointed by the City Council would serve a four -year term with a limit of two consecutive terms. The two non - voting Council Members would each serve a one -year term. The committee would be subject to the open meeting laws of the Ralph M. Brown Act. Since the appointments to EQAC are to be made in January and there were only four (4) applications received by the January 9, 2013 deadline, staff is recommending that the City Council waive the portion of Council Policy A -2 (Board and Commission Appointments) which establishes a Council Ad Hoc Committee to review the applications and make recommendations to the City Council, and the portion that requires two or more applications for each vacant seat. Douglas Wood Appointments Appointments to EQAC and the Water Quality /Coastal Tidelands Management Committee and will take place in the following manner: A. The City Council will vote on all appointments and seats on each committee simultaneously. The voting will be by paper ballot and the City Clerk will tabulate and announce the results, including the vote tally. B. Each member of the City Council will cast a maximum of seven votes per committee on the paper ballot. In order to be appointed, the applicant must receive at least four votes. My family and I have enjoyed water activities in Newport Beach since the sixties for the family and the fifties for me. We lived through the large green floating mats of algae cause mostly by agricultural runoff in the bay to the beach erosion problems during the decades I have lived in the City. These kinds of water, sand and pollution issues have drawn me to get involved over the past years to help improve the problems. I feel my long membership on the City Water Quality committee has been the most productive I've ever experienced as a volunteer. I would like to continue to contribute to this wonderful city. Long -time Coastal /Bay Committee member Tom Houston is applying for the new committee and both Nancy and I strongly support his appointment to the merged committee. Since 1986, the Coastal/Bay Committee has played a very important role advising the City Council regarding implementation of policies that have improved Newport Bay water quality. Tom Houston has been involved in initiating many of the existing policies, is knowledgeable about those policies, and continues to make significant contributions to Committee discussions relating to all issues brought to the Committee. Tom is a long -time resident of Newport Beach -- living on Balboa Island. I think it is important to appoint Tom to the new committee because he brings with him historical background on prior Committee discussions /decisions and he has an abiding interest in maintaining Newport Bay water quality.
