RESOLUTION NO. 86 -31 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF NEWPORT BEACH DECLARING CITY'S INTENTION TO <br />VACATE THE NORTHERLY SIDE OF BIRCH STREET <br />BETWEEN MAC ARTHUR BOULEVARD AND VON KARMAN <br />AVENUE, ADJACENT TO THE MAC ARTHUR COURT <br />DEVELOPMENT AND SETTING A DATE FOR PUBLIC <br />HEARING <br />WHEREAS, the City Council of the City of Newport Beach <br />intends to vacate the northerly side of Birch Street between Mac <br />Arthur Boulevard and Von Karman Avenue, adjacent to the MacArthur <br />Court Development; and <br />WHEREAS, the City Council of the City of Newport Beach <br />has considered the various elements of the General Plan of the <br />City of Newport Beach prior to declaring its intent to vacate the <br />street; and <br />WHEREAS, it is the intent of the City Council to <br />reserve, and accept from the vacation, the public service <br />easement over, on and under the street; and <br />WHEREAS, the proposed vacation is conducted pursuant to <br />the provisions of the Public Streets, Highways, and Service <br />Easements Vacation Law (Sections 8300, et seq. of the Streets & <br />Highways Code of the State of California). <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Newport Beach that the time and place for hearing all <br />persons interested in, or objecting to, the proposed vacation of <br />the street described as Parcel 4 as shown on a Map Filed in Book <br />196, Pages 40, 41, 42 and 43 of Parcel Maps, in the Office of the <br />County Recorder shall be 7 :30 P.M., or as soon thereafter as the <br />matter may be heard, May 27, 1986, in the Chambers of the City <br />-1- <br />
