RESOLUTION NO. 86 -84 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF NEWPORT BEACH EXPANDING THE <br />RESPONSIBILITIES OF THE BUILDING CODE BOARD OF <br />APPEALS TO INCLUDE ACTING AS THE <br />REHABILITATION COMMISSION UNDER NEWPORT BEACH <br />MUNICIPAL CODE SECTION 15.28.090 <br />WHEREAS, the Building Code Board of Appeals has been an <br />existing Commission since 1962; <br />WHEREAS, Newport Beach Municipal Code Section 15.28.090 <br />provides that the City Council may appoint a Rehabilitation <br />Commission consisting of five (5) qualified electolrs of the City <br />who are competent by reason of their experience add training to <br />pass upon matters relating to the rehabilitation Ind demolition <br />of substandard buildings; <br />WHEREAS, the members of the Building Code Board of <br />Appeals are competent by reason of their experience and training <br />to pass upon matters relating to the rehabilitation and <br />demolition of substandard buildings; and <br />WHEREAS, the City Council wishes to expand the duties <br />of the Building Code Board of Appeals to include acting as a <br />Rehabilitation Commission and conducting hearings on abatement of <br />substandard buildings in accordance with Chapter 115.28 of the <br />Newport Beach Municipal Code. <br />NOW, THEREFORE, be it resolved by the City Council of <br />the City of Newport Beach that the following be added to the <br />responsibilities of the Building Code Board of Appeals: <br />C. Five (5) members of the Building Code <br />Board of Appeals shall act as the i <br />Rehabilitation Commission and conduct <br />hearings on abatement of substandard <br />buildings in accordance with Chapter <br />15.28 of the Newport Beach Municipal <br />Code. The Secretary to the Building Code <br />Board of Appeals shall select the five <br />(5) Rehabilitation Commissioners from the <br />• seven (7) members of the Building Code <br />Board of Appeals on a rotating basis. <br />
